I was banned years ago from Etsy and Mercari. Etsy always asks for SSN to sell and then immediately bans me. Mercari asks for photo ID and then the same thing happens.

I do not believe anyone is purchasing the devices for inspection. I have many MDM listings which have been up for a long, long time. The only ones that got taken down all had the same description. Listings without that description are fine and the take downs have stopped.

They do know, the fact that it is an MDM device for sale is how they know. MDM enrolled devices, "should" be taken back to the organization they originated from, and the Apple Business/School manager can easily remove MDM from the device, as they own the device and willfully locked it. So any MDM device is breaking the TOS by resale as locked. Sure, if you found one or two and are reselling them as MDM locked, that would be different than bypassing, which is probably changing the serial number, which, as they told you, is encouraging illegal behavior. More than if they will know, I am concerned it is not a sustainable business model anymore.

Yes, but my point is the only reason they knew was because of the description. I have changed everything in the description, changed pictures and started new listings and no more action has been taken against me. As I said before, all the MDM bypass listings that did not give any hints are still up and selling. Only the listings that had a cut and paste description were taken down.
