Ebay buer protection case does it count?

Obviously buyer protection case counts, but I was wondering, recently and most of the times, buyers open a case for silly reasons, such as : even after I instructed them to return the item back for a refund, the buyer opened a case saying "Too long to return item back & then get refund, ebay is meant to be used for "saving time" purchasing items (which i find funny. Maybe no stores around their place)"

Anyway, my question is if I provide refund before hand, without escalating the claim to ebay customer support, will the case be counted in my overall performance?

The only time a case does not count towards your performance is if you are found in the right and the case is awarded to you .
So refunding them at any time is more or less saying they win and therefore counts towards your performance.
Cases kill accounts .. dont let them happen
