Please help - about to be sued for selling questionable goods? advise needed.. thanks

Hi,

I used to sell T-Mobile wireless phone activation PIN on eBay. I got a bunch of these from another seller for cheap. I have only sold about 40 PIN, made only a few dollar profit on each.

The other day, I received the the letter from T-Mobile wireless saying that the PIN are meant for activation purposes ONLY, and not for RESALE.

They said they have sued many "large scheme" sellers for the same thing. They think I am a large scheme seller because I sell a handful of PIN.

It is unclear in the letter if they are sueing me or not.

At the end of the letter, they said "T-mobile has the right to sue you to recover all the damages. You will not get another warning."

Does that mean this letter is only a warning?

Any advice would be much appreciated.

thanks

Sounds like a warning to me.

Hm, how did they get your address?

gotme2 07-03-2008 05:55 PM

I do not know. They must have contacted eBay for the address or pretend to buy some PIN from me.

They mailed it to the address you have on file with ebay, right?

Please pay attention that the warning is NOT to sell anymore. In other words, quit selling them.......

Yes, I have stopped selling them. I am worried if they have already filed the case or not going by what they say in that letter.

You're probably going to jail now for 20 years and Bubba is already bidding for the lube on your competitor's account. Just joking :D Seriously, you probably feel like crap now, right? Don't worry. It'll be fine. Where are you, by the way? United States? If you do end up getting a lawsuit (which I doubt), just deny that it was you. Say someone must have stolen your identity. It happens every day on eBay. If that does happen (which again, I doubt) get rid of your computer. Burn it somewhere high up in the mountains. Just so when they do come for evidence, there won't be any.

As I suggested, gotme2, it sounds like they got your information from eBay. eBay has a policy where they give people claiming to be VERO holders your info.

It's a lot easier for a VERO-holder to get your info from eBay than from your ISP.
