Ebay is getting sued by a suspended seller! Sweet!
 
The short of it:

1. Canadian (Quebec) seller opens a new account, and lists a pair of rare sneakers. Bidding hits over $96,000.

2. As we know, ebay gets nervous about this transaction/new seller and ends the listing.

3. Canadian sellers takes them to court.

4. Ebay tries to dismiss the case due to it not being held in the state of CA, but Quebec court sides with Canadian sellers.

5. Awaiting trial in Canada.

SWEET! I hope these guys win and set a precedent for all sellers who are wrongfully suspended by ebay!!

I also read this.

If they win it could expose ebay for purposely trying to take down anyone new.

Ebay knows they can be sued anywhere and not just in California.

Do they really think all lawsuits have to be in California.

They dont, I can sue them from New York and if it is a solid case they have to come here to defend it.

Nice power trip by ebay.

Going to be a long fight to have that decision by Quebec upheld...so many venues of appeals and such

I am disgusted with how ebay treats their loyal sellers.

I hate to say this, but nothing will come of it. eBay and PayPal are sued regularly (although maybe not in Canada).

The problem is, if eBay's attorneys feel the case is going to go against them, they will simply settle it. So the brothers that listed the sneakers will get some money from eBay and the case will go away. No precedent will be set.

It WILL, however, have an overall impact. When eBay (or any other large company) decides on policy changes, they usually take these things into consideration.

I'm just saying not to pin your hopes on the brothers winning and eBay changing. Any changes coming to eBay will be like the fight for racial equality or gay marriage - it will happen over time, not instantly.

I really hope more sellers follow suit. I wish I could, I'd be right there with them, but I can't come out of the shadows.

I almost feel like contacting those two brothers and sending a donation for their legal fees, that really is great that they are going after them. It's a small drop in the bucket for ebay but a few thousand lawsuits later and they might change their policies about screwing new sellers.

In my case and many others on this board the only reason I got suspended permanently from eBay & PayPal was from their "linking" crap.

Regardless what I have done as stealth it has no effect on the status of my real identity and the status of my original account. This means EB/PP has no knowledge of me re-joining as stealth.

I verified my PP account a long time ago with my SS# as they required and continued to operate for another 7 years before the extortionate link came upon me.

This kind of business should easily be seen by any court as unethical and unlawful when they attempt to have me pay for another members account with a negative balance especially when PP/EB has a separate SS# for that account that owes.

I see this as an extreme abuse of extremely confidential personal information.

EB/PP should at the very least be ordered to reverse their wrong doings and unlink many, many, many accounts that fall into the category I outlined here and then also be closely monitored for anything that might remotely be considered "retaliation" towards the cleared members accounts.

WTH, eBay uses the web to make their profits but they can operate outside of the law by merging my SS# with someone else's and then tell me word for word "if you wish to continue doing business with eBay you must pay the amount due on the defaulted account".

The CEO should burn for this amongst others I'm sure.

Oh I wonder how much they settle for........... (trundling off now to list a rare pair of sneakers on a new account, anyone care to bid ????? I shall split the settlement...........)
