MC999 TRADEMARK VIOLATION item question
 
Hey so I recently had boughten a burberry polo from a thrift shop and got hit with a trademark violation VERO from ebay sent from burberry. Haven't called or contacted anyone yet and don't plan on it. Just curious why I would get it? ha.

My listing had 100% clear description, 6 pics, clear listing title NOT misleading in anyway ..I have other clothing from them on other accounts doing just fine too ?

And I would like to know if I can re-list it maybe with a title variation (even though it wasn't misleading to begin with)

If you relist it, you better kiss that account goodbye. You might get lucky and get a 7 day restriction, but with the account being new, they will prob take the account out back and kick the hell out of it.

They say they are not targeting that account, but they are. They are watching it like a hawk.

If you list on another account, that account will probably get the same thing.

You account is probably not matured enough to sell branded items yet. And even after it matures some more, it can still very well get MC999. You need to saturate that account with non-brand, low risk items, until you get some feedback under your belt.

I've read your threads and you have put time into these accounts. You are gonna be pissed when EB indefinitely suspends them.

Nope I have had and have a lot of branded items. Ralph Lauren, Versace... no problem.
Ya ya I know I will so I'm trying to take precautions ..thats why I'm here! haha.
I wasn't planning on listing it on the same account either. Can I retake the pics so it looks different by setting? I mean I spent like 15 bucks and was hoping to flip that by like 40-50. Its not a ⊗⊗⊗⊗ polo..

That account is my strongest..meaning
It has the most listings, most money coming in and out, and most branded items. These 2 months have been to stressful. Its always something I swear

I mean they're all created around the same time. 1 1/2 months ago. I KNOW I'm not supposed to list things this quick I just need money. I have accounts set up and aging that I'm not using so I'm prepared regardless. Even if I had a aged account what does that mean when someone from burberry filed a trade mark against me? Wouldn't I get it regardless if they feel its ⊗⊗⊗⊗ for whatever reason??

It has 23 feedback, no defects, all 5 star dsr. I also offer 14 day returns, free shipping, and 1 day shipping & handling!!!

Remember this, Even with a 100% positive feedbacks you can still get hit with an MC999! No one is safe from anything.

Honestly why risk an account over one shirt? If you have a pallet full of the stuff I might understand. But one shirt. Let it go and move on with life.

But its just I don't understand WHY give me trademark violation when there isn't one? If its something I did wrong I want to fix it. I know I'm preaching to the choir as you can't see the listing but regardless its frustrating.

Did you show pictures of the hang tags. Showing where the polo was made etc. With Vero each company policies its brand differently. So it is hard to say. But when dealing with High End brands. It is best to take up close pics of all the indicators that might signal a phake to others.

Because Burberry enforce their IP rights. That's their right.

The item is one of those that is too often a phake.

Sadly sellers have purchased items from brick & mortor stores in good faith. IE, they think the item is a real Burberry. It is not.

Unless your account can withstand takedowns, leave off listing it.

Yea don't relist that shirt. I lost a good real account with listing a legit high risk item. I actually went as far as to contact the manufacturer who complained and told them I will send them the item for inspection. They were not interested even though I originally bought the item from them and even had the receipt. One less used item on ebay means they sell one more new item. I think many manufacturers are claiming counterfeit just to reduce the sale of used items and therefore forcing buyers that would have bought from an ebay seller to go buy new from them.

See I kinda new this was the answer I was looking for. This is the reason why hate Ebay above everything else... but what can I do? :spy:

Off topic but I hadn't known Ebay was doing so well with profits.. being on this forum for the past 2 months seem like Ebay needs the money! ... billionaires
