Irvine company files federal racketeering lawsuit against eBay

I doubt anything serious will happen. They will either say that its sellers responsebility to make sure that they are not selling ⊗⊗⊗⊗- Most likely its somewhere in the small print, I'm sure it is.
Then they will show how hard they work to stop ⊗⊗⊗⊗ listings and suspend some sellers.

If all else fails, they'll just settle.

Re: Irvine company files federal racketeering lawsuit against eBay

It is all going to come down to whether or not eBay can prove in court that they have taken REASONABLE measures to prevent the sale of counterfeits, and also on how the court defines "reasonable".

The only way to run a site and PREVENT all counterfeits from being sold would be to have users send in their stuff and have professionals authenticate it - which might work for items that cost thousands of dollars, like Rolex watches, but what do you do about the lower priced stuff? If you had to authenticate every DVD, razor blade cartridge and $5 minion toy, you could never sell ANYTHING online.

Going down you say? eBay has too many lawyers to fight this thing.... Business as usual for them.

I do recall Gucci, Prada and some other designer company sued EBay and those were big companies and nothing happened to EBay....same will happen with this lawsuit.

Might explain some of the recent account action that eb has taken.

I don't think so. If eBay were to suddenly start changing things and being more aggressive, it would be like an admission that they had a bad system for detecting counterfeits in the first place.

But, they could also say that when they were served with the lawsuit, they decided to review their systems and are trying to implement better methods.

At all depends on what the complaint alleges and how their lawyers decide to respond to it.

For years, eBay always claimed "they are just a venue" but they really cannot claim that anymore. And that might be the BIGGEST MISTAKE they ever made.

eBay are getting very strict on sellers compared to before, I received 10 policy violations 3 years ago within 2 months, nothing happened but 6 months ago, one MC999 was enough to suspend my account but some people somehow still manage to keep getting away with it :/

All I can say is I am glad to be part of this forum community where stealthers are responsible and do not sell such merchandise. However, there were a few good ideas in that video for items.

The only thing that is a definite is its BAD publicity for eBay.

It's been one thing after another as of late. I agree that it's doubtful anything pertaining to the lawsuit will happen but they already lost when it comes to the public.

Talking about this is no good for new buyers on eBay skeptical about authenticity of items.

I think that if EB will go very strictly about Chinatown merchandise, it will just die, as it the only real place for China sellers to sell their stuff to European end customers, except Ali, which is way less known.

That was the first thing I thought when reading the article. And it won't happened since ebay is oh so greedy.

IMO, eventually they're going to require pre-approval to sell VERO items so only sellers with verified supply of legit items will be able to list new VERO items.

I don't think they will ever have enough manpower or a system that could perform that task.

I agree. Unlike Amazon, who regularly employees real, US based employees, eBay is obsessed with the Philippines.

ebay will never go down until someone has enough money to run a billion dollar marketing campaign for a new company....and hopefully they wont get greedy like ebay...from 3% to 10% fees i think everyone on this forum can agree that eb is a necessary evil for us to make money but wed all love someone else to take it down

Hard to say, I know Amazon does this with per-approval. Especially with eBay hard to distinguish between new and used items, etc. I think it will it be remain pretty similar to what it is now. For the most part many phakes in certain categories have been largely eradicated from eBay. Those few who are on are new sellers with like 10 feedback and it will be over sooner than later. Unbranded fringe phakes is another story. Who really knows how it plays out, I think eBay will continue to operate pretty much as it already has been. The big purges happened about 5 years ago.
