Default seller is threatening to sue for non payment

Hello, I wanted to know what can happen to a buyer if he/she breaches a contract on ebay for non payment. I know the seller can sue, but would it even be worth it? I recently won an item worth over 1k, but am now having trouble paying for it. He sent a message to me, threatening to take legal action. Has anyone here ever been in this situation?

I don't think it would be worth it... but even then If i was in the position, just to be able to sleep easy at night knowing nobody has it out for me, I'd send a remorseful letter explaining that I simply don't have the funds at the moment, offer to pay if he's willing to wait around 3 months while I recollect my finances (he won't), and just play for his sympathies so hopefully he drops it.

Second, this is why you use Stealth accounts.

Third: Even if he does sue, is he really going to hire an attorney to represent himself? The court costs/attorney costs would be greater than 1k. If he sues, he's a moron with more time than brains.

In conclusion: I would tell him to shove it.

I would also call this a bluff. 1k is definitely not worth the trouble for him.

legal action lol. dont expect to get sued on ebay by snother ebayer or by ebay themselves. it will never happen.

why do you think they can sue? there is a framework of ebay being used and so cancellation before dispatch is offered as an option. You cannot sue and win if you have no expenses, so if they cancel and get fees back and do not pay for postage, they are not out any money.

I mean you are a PITA buyer for doing it, but a seller should rather have tht scenario than a cancellation after they pay for shipping, which they wont get back. Sellers get alot of hassle and idiot buyers and they probably had a bad day and are taking it out on you.

ask the seller to set out what are their expenses if they do not sell to you - they shouldnt have any, if they handle a cancellation correctly (well maybe an insertion fee)

Tell him to sue you.

He can cancel the sale/transaction, block you and keep it moving. He will even get his FVFs back.

Dunno why youre having trouble paying (Either through not wanting to or just paypal issues) But thats not allowed on ebay on the sellers part.

Also, $1000.00 is a joke value.

I would report the seller to ebay as well. Nit the type of verbiage ebay wants its sellers using.

Seller is definitely bullying you to just pay up for what you bought - lawsuit over $1k is frivolous.

But - situation aside - don't make a habit of winning stuff you can't definitely pay for...as a forum for sellers, we deal with these kind of buyers and it's a hassle.

Hey, you can always pay, then open a case for defective and send it back. Sellers like this are novice at best. Very unprofessional.
