2 big disputes

So heres my dilemma. I bought a slightly used macbook pro on ebay for around $1900. Paid seller. All good. I get the item and it is clearly not as described. it has dents the seller didnt mention. It was also 6 months older than he said it was. I tried to work it out and ask for some money back which he refused so unfortunately I had to file a dispute with ebay which I won of course. Got my money back. I found another macbook pro on ebay. This one was a bit more expensive at $2100 but still cheaper than full price. Now I am waiting and its been two weeks and the seller seems to have gone away. No responses, no updates, called his number. No luck. So I am feeling like I will have to open another dispute. Id rather not and hope the macbook pro gets here but what are my options. This is a stealth account in great standing that I dont want to loose. Are there any suggestions on what to do? I mean my issue is that this is 2 pretty big disputes opened within a month but what choice do I have? The first auction was a clear misrepresentation of an item and the second has not been sent.

I opened the first dispute with ebay. Should I open the next with paypal since they arent the same company anymore? Should I open both with ebay. Should I call ebay to open the dispute and explain the situation so it doesnt look so bad. How will this situation affect my account. Any info is greatly appreciated.

I sense karma. But I may be wrong.

P.S. Both Paypal and eBay will know if a dispute is filed on one end.

you have 60 days to lodge a claim.

do not worry about opening cases.

its not the amount of each claim that they look at its just the number of claims.
and 2 is nothing.

put it this way a large account my friend ran had 163 cases opened in a 12 month period.
as a lot of the items he bought were faulty, its quite common in his industry.

ebay also send a warning about the case opening as unusual behaviour
so you are no where near that e-mail let alone a ban.

get the dispute open in PP.
make sure if he accepts the return you send the item DHL or UPS (a service with guaranteed delivery)
upload the tracker
and escalate it in 10 days or so.

if he does not accept it escalate the case when it gives you the option.
usually about 10 days. it may refund you without having to return the item, but if it doesn't dont forget to return it and upload the tracking again.

the amount isnt that large they wont bat an eyelid.

Did you end up getting the first macbook for free?

I only ask because there's a good chance the "2nd seller" you are attempting to deal with is the same seller using another account, and he/she may be trying to avoid giving away another macbook. If that does happen to be the case, I don't know why the seller wouldn't just cancel the order.

Either way, I wouldn't hesitate to open a case for such a large ticket item.

I would open the dispute again - big ticket item but with 2 disputes in a short time, I would let the account cool off on "possible" big ticket purchases for a while - just small stuff with low risk of problems
