Cease and Desist Letter - Vorys
 

Hi there,
After some advice, received an email with a PDF letter attached - CEASE & DESIST - ARBONNE PRODUCTS.
More or less tells me to take all listings down immediately otherwise Arbonne will sue me for all damages etc etc it is a 4 page letter signed by one of the partners, lots of scary legal talk. I googled the law firm Vorys and they do exist. Has anyone else had a similar experience, and if so what happened? Is it just a scare tactic? This was a letter sent to my external email account (paypal email) and nothing has been received within Ebay.

Its probably sent to your PayPal email as they made a test purchase and found it to be inauthentic, so they could easily retrieve your PayPal email from the transaction.

If they aren't the real deal, you should cease to sell them because the likelihood of this being a genuine email from the law firm becomes increasingly likely.

Weird that they did it like that, instead of just telling EB to take you down. Anyway, I'd send them explanations and proofs about authenticity of your items, so to sell them legally.

If you are confident that your products are legit, just contact them and see whats happening- Ask them whats the problem and try to solve it with them.

Some companies just don't like their products being sold in ebay. They think it devalues the brand.

You can contact them and try and get their permission. But if they don't want it sold, you won't get very far.

search google and you will see they do this a lot it seems,
so it is clear they dont allow there items on ebay.

Be glad that is all they did to your account.

Kind of doubt it based on Illegal Online Seller Enforcement: Vorys, Sater, Seymour and Pease LLP - chances are low it's a competitor

Yes I believe it is Legitimate Funny how they pick & choose sellers though, there are so many other sellers listing the same products, interesting to see if they pull their listings

Legal action is completely random from what I've noticed. Seems like lawyers will pick on small sellers all day rather than focusing on the sellers moving ten of thousands of dollars worth of product every week.

A buddy of mine got a C&D letter a few months ago and he took it extremely seriously. Immediately liquidated all of his inventory and hasn't sold anything online since. I kind of feel bad for the guy, but anyone selling knock offs has it coming sooner or later..

No I don't think so, I treated it as the real thing considering it came from actual legal firm's email address (googled it & is actual law firm & email etc matched)

Received a letter from Vorys about Linksys products on amazon

Looks legit but is possible scam from other sellers on amazon that hired this firm that sells this service online.

This is probably a legal letter but is just to scare you and stop you selling on amazon Linksys.

I'm pretty sure Vorys can do nothing more than contact amazon to remove the listings but amazon probably won't remove anything. Linksys needs to be involve and is more simple to send a scary letter to the sellers (competitors) than deal with amazon about the listings, sellers etc.

Anyhow Linksys is now a low quality brand with many other new competitors and profit is very low to resell on amazon.

I received many returns and my inventory was almost zero when I received this letter.

doesn't worth the time to deal with Vorys or whoever sent the letter.
