The official line is new listings past their policy review (was it about 2 years ago) were not permitted to have watermarks as part of their new-fangled shareable catalogue system. Listings created prior to that are okay to retain their watermarked images.
Do they monitor it....I doubt it if the mountain of non-compliant images are anything to go by.
Will they take action against another seller using your image.....possibly, who knows with ebay? If I stole someone elses image I'd simply say "it's a stock photo" or amend it it in some way in photoshop - which I've done before and never had any repercussions.
Whilst I'm probably a bit soft, I've always wondered what could happen to my account if someone stole my image, I report them, they lose their account and decide to go after me out of spite. So I've stopped caring.......
