Perm banned however..
 

So my eBay is permanently restricted from selling for counterfeit violations, even though it was for listings that were already deleted but that’s besides the point.

I have family members willing to give me their eBay accounts (one UK, one is US) however they don’t want to be tax liable, what would be the correct way to attach my LTD and LLC to these accounts? Also how would I avoid a Mc105 where they think the account is stolen? I want to do this the right way as it feels like my last two chances of being able to sell on eBay.

Any help would be greatly appreciated thank you

First question - are you going to be selling the same things that got you violations on your main account?

For correct way, I haven't done this kind of transfer but perhaps other members can chime in.

I'm still a fan of just creating your own accounts and going fresh - harder, yes but better than playing with family members accounts.

No it wont be the same products, I sold 5,600 items on that account over 2 years before I messed up badly, I realised I messed up and immediately removed all the bad listings but I still got violations for listings I deleted which led to the suspension.

Making new accounts seems next to impossible, every single one I create is immediately banned.

Maybe head over to the marketplace and buy an account if you don't know how to make them yourself. I also would say it's a better idea then getting family members involved

once again. taxes... buying accounts in fraudulent details cannot end well, unless im missing something

ebay do not allow change of ownership so if you would like to do it completely legally the account owner would need to use their own corporation to upgrade and you would later take over the corporation from them

all this has some verification risks , the issue is that ebay have their own rules so that legally there is no problem to change ownership of corporations but you can not be sure whether verification will work out

what is however crucial is the current account owner must upgrade to business and be verified , name change on upgrade would certainly lead to verification failure

on such operations taxes should be your least problem as ebay suspend people for smallest things , it is like a minefield with zero legal options

I do not use a corporation so in my case self assessment is sufficient , whether it is stealth or not it does not matter for taxes

you are asking about limited companies and llc's and this is where you have the main risks as your concern about taxation is meaningless since you need to be able to sell. I saw many people here over the years concerned about taxation instead of verification although verification is the actual bottleneck where most people fail

just recently there was a guy here who got advice from lawyers and officially purchased an amazon account , likely paid thousands of pounds for it to the company that serves as middlesman between seller and buyer. and amazon took it down on verification. it turned out legal advice does not matter to amazon as they run their own rules on who can pass verification which are much narrower than what is legally possible

the same is with ebay too. I would even say ebay is stricter in many instances , for example they strictly forbid non-residents of any kind incl. company owners and directors , they forbid change of ownership too that is why there are no ebay accounts officially for sale

which by the way raises an interesting question , how are you going to run a US and UK company? are you a US and UK resident? ebay strictly forbid non-residents

Thank you, so essentially if I purchase a stealth account from someone on the marketplace here, the account would not be in my details but because it’s attached to my bank account I could file an assessment as a sole trader? I’ve been trying to do everything by the book etc and it seems fraudulent to me. If I can just purchase a stealth account and file as a sole trader then I’ll go ahead so please confirm if that’s the case thanks for your help btw!

you file self assessment and run turnover through your business bank accounts , as far as taxes are concerned your stealth or non stealth setup is meaningless

As they say here in the US - tax avoidance is legal, tax evasion is not...

Firstly, discontinue selling those items entirely. There is a method to selling brand alternatives with the branding edited off pictures and listing as "Unbranded" but it's still a grey area and high risk.

(also eBay uses AI mostly to determine counterfeit items, if it isn't counterfeit you may dispute it, if it is counterfeit, don't sell it on eBay you will get banned eventually)

Secondly, use a good VPN service such as IPBurger if using your relatives account through a browser such as AdsPower to avoid leaks and linking your suspended IP with your relatives account.

Regarding tax, doubt it's possible as it's under the account holders details so they will be liable. Better off creating or buying a stealth acc than using your relatives acc at that point
