ivegotinfo | 11-20-2007 06:21 PM | you can appeal vero.
reply to the ebay message asking for a "counterclaim form"
after that, the reporting agency
( Disney, LV, Warner Brothers ect)
Has 10 Days to file a claim against you in Court prohibiting (Restraining Order) your relisting of their products
If they Fail to file within the 10 days eBay will allow you to relist your item with immunity from take down one time.
you are only allowed 1 relist per claim filed KEEP TRACK OF THE NUMBERS
For every takedown you need to file a counterclaim
if you do go to a Magistrate hearing; you cannot be financially sued
the worst outcome will be a restraining order prohibiting you from selling that 1 particular item.
Selling 50 different items that have been taken down; you must appear before the magistrate 50 times!
you can read more at taberone.com Tabberone's Trademark page.
here you will see what a counterclaim looks like http://www.tabberone.com/Trademarks/...otice2003.html
(all this info is from a person i talked with over half a year ago by email so not my info)
also,
since anyone can sign up to be a "vero" company, and ebay wont check you, it might even be someone competing with you that did this. |
