if you use a real persons name?

I have to ask, what if by chance you use a real persons name on making your ⊗⊗⊗⊗ account? even if you didn't mean to. can you get in trouble for identity theft?
Can the real person press charges? knowing my luck I would get caught. I am running out of ways to misspell my own name :rolleyes:
