Suspened after 6 years

One of my employees who was in charge of shipping just lost interest in the job and was shipping late.

I'm thinking about suing them for closing the account.

Has anyone tried bringing them into court for their crap?

I see a few folks selling these so called stealth accounts but don't feel comfortable doing that, perhaps I don't yet fully understand how they could possibly work.

As far as the book being sold here there is no info as to generally how it works without giving away any secrets.

buy the stealth book and dont look back

personally i would call them and see if there is anything to be done

unfortunately i would think that ebay would take the stand that you are to blame for not ensuring that your employees are doing their job

if we all could get around suspensions that way (it wasnt me it was them) then life would be simpler

There is never a way back from this. Many people on this forum has been in the same shoes has you.
Gone are the days when eBay needed some time sellers.
To suceed, you need to go stealth.

That's the onlt way forward i am afraid.

you werent watching the account and the activity of your workers?

jimbo2012 05-06-2012 08:01 AM

yep I trusted that employee for over 4 years, now he has plenty of time to think about it on the unemployment line.

So should I buy the book or just buy an aged stealth account from one of these resellers?

Or did they just read the book:boink:

I think if you read the book, you would be more control and understand how stealth account works.
By all means you can buy a account. But i would strongly advice you get a eBay Stealth

Welcome to the forums.

I will say that the guide is solid for simplicity - you can also piecemeal info from here to learn about stealth.

Good luck on that - it will likely get tossed out of court. You had a sloppy employee who did not do his job correctly...corrective action? YOU FIRE HIM...court will not decide in your favour. If he was stealing from you or willingly working for competition, then you may have grounds BUT PROB BEST TO CONSULT AN ATTORNEY to see if different grounds are present. Will be a tough case to prove.

That's only my opinion as I am not an attorney. Forum does not give legal advice.

What you have to understand is making sure not to be linked.:smash:

you have no chance in court....

At this point, stealth is your best bet. But you need to understand the stealth techniques. Simply buying an account will not help you if you don't know what you are doing. Buying an account WILL save you time and time is money. But you need to know how to KEEP the account.

More concerning is the apparent lack of controls you have in your operation. That needs to be fixed immediately. As a business owner, you need to understand and monitor what is happening within your organization. Even good and trusted employees can go bad, for various reasons. Everyone can experience problems with family, health, etc. And sometimes they can just get lazy.

If you know that you are selling 300 items per day, then you have to know how many packages are being shipped each day. If there is a discrepancy, you need to quickly find out the reason why. Maybe it is normal, like being out of stock on a certain item. Maybe one person could not pack and ship 300 of whatever you are selling in a day. Maybe the employee got lazy. But you have to identify the problem quickly and fix it before it does damage to your business.

A lawsuit is going nowhere. Sure, this is America. You CAN sue anybody for anything you want to, but that does not mean that you can win. I have only seen employers successfully sue employees where there was criminal conduct, or evidence that an employee acted maliciously to harm the employer. If this employee was trying to kill your business rather than just being lazy, then you may have a chance.

But, lets say you were able to sue AND win your case. Then what? Does this ex-employee have money in the bank that you can attach to satisfy the judgment? Will his next job pay enough for you to be able to garnish his wages? Will you even know where he is working? Will he simply file bankruptcy if you get a judgment? 80% of all money judgments go uncollected. Winning a case is a lot easier than actually COLLECTING the judgment.

I don't mean to offend you or upset you, but if I were an eBay rep and you called in trying to get the account back telling me the same thing posted here, my thought would be - this guy is TERRIBLE at running a business, he cannot control his own operations, why would we want him selling to OUR customers and disappointing them? So, I don't see eBay giving you the account back, although maybe it is worth a shot.

Going stealth and simultaneously fixing your operation is your best bet, IMHO.

As an owner you can't hold the hand of a department mgr everyday, why pay them good money?

This guy was golden until this.

It would have surfaced at our quarterly meeting anyway, the timing was a bit off to catch it in time.

My Amazon mgr does 30% more orders than ebay ever did never a problem.

In any event I'll get back on track, no offense taken by your comments.
