Reinstatement for listing removed for trademark violation
 

My few listing were removed by ebay for trademark violation.

As I can prove they are genuine brand items, I wrote to ebay to try to get permission to relist the items.

Following my enquire, ebay dennied the request with the following reason:

"The removal was the result of your previous rights owner violation. It is important for you to know that during the investigation, we also review your account for the past 12 months for related policy violation. On your account, there were records of Replica and rights owner violation, which were used as criteria when we review your listings."

I used to sell a few unauhtorized items using this account and get trademark violiation twice and a few negative feedbacks.

I am also advised to stay away from brand items for awhile and try to build a positive feedback history.

My question is if I should listen to this advice and remove the other genuine brand items. And how long should I wait till listing these brand items again. Do I need to wait 12 month till my account clear its historical bad records?

Gotta love eBay. *Everything* is a brand item. Seriously, what is the last thing you bought that wasn't branded in some way or another.

The records are never erased. 2 years from now, they will give the same "we have reviewed past violations on your account and have concluded you have a pattern of high risk selling behavior" when they can you.

Ovidiu is right, the violations may go away in terms of them scoring your account, but they will never be erased and will always be there for eBay reps to see.

I would make some more accounts, but you have to realize it is difficult to sell hot name brands on eBay, ESPECIALLY when the account has a history of selling phakes.

It is also true that most things we buy and sell are branded in some way, but the ones that are difficult to sell are the ones mass produced by counterfeiters. Selling Louis Vuitton or Coach will be difficult, but you can sell all the "Donald Trump" watches you want and nobody will bother you. Of course, you won't have very many sales, either.

If you want to sell AUTHENTIC brand name items, your best bet would be to approach the brand owner through the VERO program and ask for their permission to sell. They will probably want to know where the items are coming from, but if you can prove they are legitimate, many brand owners will give you their blessing. If you are approved by the brand owner, then eBay probably won't bother you.

I am done with the "true" branded items. No interest in catching that type of attention.

Seriously would not have sold what I did had I not thought they were the real thing.

When I was speaking with the rep on the phone about selling history and habits I thought back over the years --- a long time ago I sold things I picked up in yard sales and the like. Needless to say many of those were clothes, and branded as well.

I don't know that I would even risk that any more.

You really have to know your stuff to do this successfully, to make sure when you buy an item it is not a ⊗⊗⊗⊗. And some of these counterfeits are GOOD - VERY GOOD. I once took a Rolex I suspected of being a ⊗⊗⊗⊗ (due to the price) to a Jeweler. He looked at it and initially said it was real - until he unscrewed the back - it was not a real Rolex. But the outside had him fooled. So, spotting a ⊗⊗⊗⊗ is not always easy.
