Sorry for mentioning Ebay here, but in this case it's pretty much the same.

A buyer who must have been connected to a Chicago law firm purchased something from my store, I happened to not have the item in stock and I did not ship it. I canceled the order. Even so, after receiving several emails and removing all the ads, I found myself involved in a case in a US court. Ebay closed my store yesterday after the judge's final ruling.

In mid 2000,Tiffany took EBAY to court for false advertising-it allows ⊗⊗⊗⊗ Tiffany trinklets made in China for sale on Ebay,it lost the case as the court said it is the manufacturer job to make sure no counterfeits are sold.
Since then,Tiffany and other manufacturers come to Ebay ,either their own staff or proxy or Vero to take down ⊗⊗⊗⊗ listings,Ebay would also do so when someone reports .
So back to Restaller's case,Ebay would protect itself by removing all listings.
