Dropshipping a "patented" item or not ?

Hey guys,

So, me and my mate have found an item that seems to have anything good to be a dropshipping item, it would be our first one, we're willing to start :D

So, this item doesn't seem to be on the dropshipping planet yet, it would have a nice margin, well it has everything we want for a good dropshipping item.

BUT, but... it seems like this item exists under a brand, i've seen only one brand so far, and they say in their legal stuff that they have it under patent, they even give the patent number.

For info this item is worth a couple $ on Aliexpress.

So, this company has 30k followers on Instagram, it's not that much if you consider it all.

Now, my question is, being a seller of a product that looks a lot like this one, not being the manufacturer, do we risk anything dropshipping this item ? The aliexpress version, of course, doesn't have any branding on it.

We really think it could be a good item, but, hey, this patent thing is scaring us a bit...

Does anyone of you have any opinion on it ?

What is the category of the item? Don't need to specify the exact product - for analysis

There is the risk , you can try to sell using different words/ keywords/photos

If it's already under a brand name, then there is copyright issue...you would be dropshipping a knock-off it sounds like...decision is ultimately yours but buyers might be disappointed if they see a big difference in what they expect vs what they receive...
