Fighting an eBay VERO Takedown

Great post, Yoz!

Has anyone tried it, looks pretty time consuming.

Lyda 10-25-2009 12:21 PM

Maybe time consuming, but I believe it works.

Counter-Notice takes about 5 minutes to fill out, from my experience
it only works if you have a copy right violation in United States, if the VeRO member is in UK, it will not work. If it's a trademark violation, it will not work.

Lastly... your item has to be real... otherwise you might run into some legal trouble if they decide to sue you...

VeRo member can take down your listings again... if you put up new listings, this is only to restore your listing/ not sure about the violations...

The link Yozalo provided explains that this only relates to real items and not ⊗⊗⊗⊗. It also explains that Counter-Notice does not cover Trademark violations and why it doesn't.

Why does it matter if the items are ⊗⊗⊗⊗ or real. Either way they do not know if it is or not. Lastly this is a stealth account so I don't think there will be any legal issues if perhaps the item is not genuine.

They will know if the item is real or not from the pictures you put up.. and if you put alot of the items up, they will ask you for your supplier information...

I have managed to read the whole post and done more research and there is a huge difference between the Trademark and Copyright Violation. The author states in the link:

That loophole I mentioned:

You can appeal copyright VERO takedowns. You can't appeal TM (TradeMark) takedowns. This is a total abuse of the VERO system (but what isn't?) and one that eBay sticks it head in the sand on.

It means that there is nothing you can do to fight Trademark violations. Unless somebody has a different information I would really like to hear.

Trademark can be challenged based on Fair Use. Not sure exactly what steps would be required to complete it successfully. But it would definitely be an issue of Fair Use. In the legal system, not through ebay.
