I think the fact is that such large sites are aware that counterfeit items are being sold. And, to save them from having legal action taken against them, they give IP owners the option to report items. It makes the website look like they care about IP owners.

aspkin 04-29-2008 06:35 PM

Any site that doesn't want to get shut down must take down such items.

2eXclusiive 04-29-2008 06:56 PM

but how can a website get shut down if you own the site and you have 100% control over it.

aspkin 04-29-2008 07:04 PM

You don't have 100% control over it. The hosting company if they have complaints againts you can disable your account, and your domain register can disable your domain as well. As well you can get sued by the VeRO member if you continue after their warnings. If you're outside of the US though, you might get away with it. It's just not a good idea, thus companies like eBay obey VeRO members.

Check out this. It may help you get the general idea.
IntellectualProperty - Wikipedia, the free encyclopedia

Gives a reasonable explanation as to how 'invasive' IP rights are.

jscan 04-29-2008 08:43 PM

oztion claims to monitor there listings periodically for counterfiet items which is so not true.

Hmm FAQ about DMCA Safe Harbor Provisions -- Chilling Effects Clearinghouse

Is it correct that these sites really only need to do the proper DMCA procedures and so all this overzealousness is from the sites themselves?

2eXclusiive 04-30-2008 04:11 AM

yea, but there are alot of websites that sell replica watches, bags, phones... etc.
why don't they get shut down?

jscan 04-30-2008 05:05 AM

its got to do with where the hosted / based.

There are countless websites from china selling counterfiet items, take your pick they will have it. Chinese law is hopeless, and when it comes to counterfeits they turn a blind eye. theres hundreds of factory's in china which are set up as proper businesses they soley produce counterfiet items, the gov is doesn't give a crap

The rest are usually located in the USA. while i dont know much about the laws and how strict they are over there, im guessing its seen as a small problem which is rarely policed

2eXclusiive 04-30-2008 05:20 AM

but how do people know were you are based?

jscan 04-30-2008 06:28 AM

doesnt matter if people know where your sites based/hosted, it matters if the authorties know and give a crap which is rarely.

2eXclusiive 04-30-2008 01:45 PM

oh aright, because i think its impossible to see who's hosting your website, and i think the only way to find out were your located is from the package you recieve were it says "from"

2eXclusiive 04-30-2008 03:08 PM

how is that modee?
also can you guys/ladies give me your opinion, i would extremely appreciate it you have no idea, i have been thinking of all different ways to have that perfect professional look to my website, i have not launched my website yet, but this is how it looks so far

home

thats the home page, what can i do to make it look more professional?
all comments are extremely appreciated even if its negative it still helps me out
thanks

GreenBean 04-30-2008 05:55 PM

An observation

Hmm. Your site is created by a Canadian company that does offshore work. You have a very 'smart' car as your avatar, your merchandise is high end gear, the site is fine but sterile and this makes me think the following things. You may well be from Asia [?Hongkong]or India educated in North America as your English is excellent and you possibly living back in the country where your parents were born. With the items you are selling, you are not going to pay high freight costs. so you are near your product markets.Probably also in the 22-28 year age group and male.:p

2eXclusiive 04-30-2008 06:10 PM

GreenBean - Yes, it is in the process of being complete, i had to figure out what i wanted on my site, as well as what should go where, so i was just asking in terms of looks
when you say "sterile", can you be a little more clear as to what you exactly meant?
oh and by the way before i forget i want to thank you for taking your time to look at it and give me your thoughts on it

*Congrats on your 1000th post
;)

2eXclusiive 04-30-2008 06:13 PM

oh and btw when you said sterile i didn't know if you meant uninspiring or lack of imagination or both?

GreenBean 04-30-2008 06:25 PM

It seems to be a combination. Look this is YOUR website, so you have to put passion into it: have the goods scream out to attract buyers. Look at this site
Color Psychology and Marketing
A change around of font styles, sizes and colors will work well.
Thank you for your thanks.LOL. Was I close on anything else?

2eXclusiive 04-30-2008 06:33 PM

thank you so much, im going to read all of it
if your talking about the info about me and not the site then in that case,i kind of feel bad saying this but since you asked, you wasn't even close
;)

GreenBean 04-30-2008 06:36 PM

No need to feel like that at all. Good luck with this and please keep me up to date.

2eXclusiive 04-30-2008 06:39 PM

thank you, and i will be more then happy to keep you up to date

the_blue_messiah 05-05-2008 07:03 AM

jscan 05-05-2008 07:14 AM
