This is more of a business contract dispute than a trademark infringement issue.

Nike WILL NOT win. Tebow has a contract with the NFL which allows his name to be used, just like anyone else who plays/played for the NFL. In a couple months when Nike is the official NFL jersey supplier (lol to all those who sell jerseys), than this would be a legit claim, but not right now.

Tebow is now a backup QB with the Jets...or so they say.

Jerseys are the dumbest thing to buy and sell. Reebok did not give two sh!ts about knock offs, but I can guarantee Nike will start giving sellers the boot as soon as they go into production. Jersey sellers have no idea what is going to come within the next 6 months to a year.

Better grab all those Jets Tebow jerseys as I just dont see him in NY very long.

again, its going to be interesting to see how many listings there are this year compared to in years past. i'm sure NIKE's VeRO people will be out in full force since this is the first year of their contract.

i dont think NIKE has any standing in this case however. reebok still was under contract to sell jerseys, at least until the end of the month. they were smart to make this last run and cash in on a few NFL trades before they were done

Im not sure who is cracking down but they have took down pretty much every manning and tebow jersey down and have gone through completed listings and done the same.
