Anyone own a retail store?
 
I came across a retail store at the mall the other day that sold counterfeit stuff.

This is the first time i came across something like this. From what i read it doesn't seem too complicated to open up a retail store. But is there no paperwork needed on where these items are coming from, their legitimate/authenticity, and so on and on? I would think retail stored are investigated/monitored by some type of group that checks for this type of stuff.

Anyone mind educating me a little bit on this topic?:welcome;

I closed my stores and to answer your question, No.
It is the job of the vero rights owner to do this stuff. Same as on ebay and amazon.

So the guy will keep selling counter merchandise at the retail store until lets say "nikon" camera rights owner comes after him for doing so?

I can tell you this, if ANY agency of any kind walked into my stores and asked me for receipts, I would start laughing and have them escorted away by local police and a trespass warrant issued.

It is no-ones business who I buy from or what I pay.

Does that make sense?

But for all intensive purposes, very few retail stores sell ⊗⊗⊗⊗ crap and last very long. Who wants to deal with disgruntled people face to face? Who wants to answer obnoxious phone calls? Calling the police, etc...

Also, how many sales does a retail store have compared to amazon or ebay?

I was the largest dealer in the world for two manufacturers in the archery industry for years and years. I make more profit online in one week on ebay that an entire year of local sales....

Retail stores have little velocity in comparison and a ton of hoops and rings of fire to jump through. Odds are that store does not sell enough to bother with..

Yea i know but how do they catch sellers like this in retail scenarios. I've seen online sites and eb people get taken down but never a retail store. I wouldn't imagine a brand has a team of people going around the world inspecting stores for their items being sold and their authenticity. Just seems like its rare to be caught unless a buyer makes a complaint to the rightful owner.

and even then, how can one prove damages?

It is a fairly small occurrence compared to online sales. I am sure huge flea markets and sorts do have people monitoring the places know for foofoo goods.

But even then, little one can do.

No 1 is gonna complain if they are getting deals on merchandise unless it's cheap ⊗⊗⊗⊗ crap
They don't have to send people store to store these days they check social media and websites
Someone has to complain to police they can get their store shut quickly once investigation is done by undercover cops Just like they cracked down on ⊗⊗⊗⊗ bags in china town being sold out of stores It's just a process
Unless that guy is making huge profits why risk it. The fine he will get once he gets caught he would lose all his profit.

In Vancouver if you get caught selling cakes they fine you a lot. Whether you are a consignment or thrift store. Massive fines and other measures could be taken. People at flea markets sell ⊗⊗⊗⊗ electronic stuff all the time.

Who fines?
Are you very specifically referring to designer clothing/electronics?
Trade shows and flea markets is the outlets for "cakes"

I worked at a well known thrift store the fine was 2000 per item and eventually they shut down the store. That was for clothing, purses and jewellery. Electronics I don't think they monitor.

Here in australia we have a Trade Marks Act and a Copyright Act all in which makes the vendor criminally liable.

A few years ago there were huge sweeps through Melbourne markets targeting falsified goods and other illegals.

Damages only need to be proven if the Registered owner takes action and since you're committing a criminal offence - authorities would pursue them with ease after the 10's of thousands dollars fines and potential jail time.

Im sure the rest of the western world would share similar legals.

If you are doing shady things out in the open at a retail store your just begging for a load of headaches

Once there are complaints filed and the word gets out than the company sends basically copyright police

They just have scanners and will scan the product and will know right away if it is real or not

And than if not they will take all your merchandise and issue a lot of fines , and if your stupid enough to keep going than you will lose all your merchandise again an get heavier fines and than eventually shut down and possible jail time
