Hi,

I ordered a set of four tires outside eBay, paid with paypal via credit card.

The seller shipped in two shipments with two tires tied together for each.

However, I had only received three tires because the tires came loose during the shipping process. The seller did not do a good job at tying them together.

I did not have to sign for the shipment when it arrived. Fedex said the missing tire is lost as they can't track it down without a label attached.

May I ask what is the good way to get my money back? The three tires are useless to me without the fourth one.

Does the seller need to refund my money first while he tries to file insurance claim?

If does seller do not agree to refund, can I file claim with paypal, then chargeback my credit to get my money back?

In that case, may I ask what the paypal claim I need to file as? item not received or not described?


Thanks for all the help, and I would appreciate any advice.

You need to either get it right with the seller or you will have to file a claim with PayPal.

Assuming you purchased Insurance or it was included. The seller should file a Insurance Claim and Once the seller is reimbursed then the seller should issue you the refund.

Fed-Ex should have automatic INS for $100 at least and the seller should not have a problem. if the seller refuse then you can open a Dispute with paypal as "item not as described".

If you choose "Item not Received" then Chances are you are not going to win.

Boomer - May I ask why you recommend item not as described as opposed to item not received?

I did not have to sign for the shipment, and the transaction was $250.

Because you can't win a claim for item not received if the seller can provide delivery confirmation and/or tracking.

Have you even called the seller to work things out?

99% of the time a simple phone call will straighten things out.

Paypal rules say that anything over $250 needs a signature and tracking number or it's invalid.

In my case, fedex didn't get my signature for the shipment.

I lost 2k when I received junk instead of original items... if I had used a credit card, which I'll do from now on I'd charge it back.

BooMer's advice was to enable you to have a better chance to succeed with the claim. Why? You had an agreement to purchase xfour tires. This is the base line, the four tires. That one tire{one item} is not received makes no difference. The seller had a duty of care to make sure that the packaging of those 4 tires was safe to ensure the completion of the sale. He has not so you can try for an 'item not as described' claim.
I would think you need to speak to the seller and attempt a resolution.

yes, paypal isn't much better than western union... opened dispute and went for claim... immediately case closed. Paypal can only determine delivery not item described. I called them and said what if I received marbles instead of a laptop.... "we can only determine if an item is delivered".... so I can sell marbles for 2 grand. "silence" You'd be liable for that. What if I received marbles? We can only determine delivery. So I can sell marbles instead of laptops, ok I'm going to the store and stocking up on marbles... maybe after I'm done selling marbles for 2 grand you can rethink your policy. I hung up. Before I could sell my marbles I got limited for invoice request... it was two hours later. They didn't like my invoices and I got limited forever. You can sell marbles for 2 grand using paypal as long as you sell off ebay. I wasn't sold marbles but plastic pieces with funny writing that says something in another language, not u.s. version. EC21 sells marbles!!!

Since when are three tires useless. You currently have four tires on your car. Take the two best (least wear) and move them to the rear. Place two of the new tires on the front. It is a myth that all four tires have to mach. As long as the front match, and the rear match, you will be fine.

It sucks that you bought four and only received three, but try to make a negative a positive and you will feel much better. In other words, it is not a total loss.

There tires are far from usless my man. Now all you need is one tire, which, you could get locally.

Two choices:

A) Allow seller to ship you the missing tire.

B) Call your credit card company and file a chargeback. Tell them you ordered four tires, you only received 3, you told the seller, seller refused to ship you another tire, and refused to take back 3 tires. Thus you get three free tires. This will allow you to buy tires locally.


By the way, I have a performance mustang, and I buy all my rubber locally. I tried online, not worth it. You still pay installation AND disposal, which are free if you buy locally, just have to find that right shop.

I smell a fish story. If these were tires and rims, would they not have been shipped in boxes? This story does not add up. No shipper would allow a shipment of a set of rims and rims "tied" together. UPS, FedEx, USPS are not that stupid to allow a poorly designed shipment.

I ordered tires only. hmmm, rims do not come tied up since it may be damaged. I smell something fishy.
