Anyone familiar with AppDetex, what they are doing is illegal but goes under the radar, they pass off as other companies and make reports of infringement which causes Ebay or Amazon to remove your listings. By Law the rights owner has to make the claims directly, or their legal representatives, AppDetex do not provide legal services of any sort.

Never heard of that company but if its a UK one I wouldn't expect to have heard of them. Maybe one of our UK member has.

They're just one of hundreds of intellectual property enforcement companies. How is what they're doing illegal?

At least your takedowns were initiated by an actual enforcement company. I've had chinese competitors setup eBay "VeRO" accounts that have a freaking "QQ.com" email address as the contact (although it's an American company who makes their products in America), and eBay still complies because they're scared of getting in trouble.

AppDetex is being paid to monitor marketplaces and initiate takedown requests, so they are an authorized representative. eBay's policy does not say authorized representatives have to be attorneys. AppDetex is being paid, and they have permission from the trademark owner, so they're in the right.

The Community Design Rights Regulations of 2005, state that a party cannot make legal threats that will directly result in damages or loss of business for the accused party, if that party does not have the ability to defend their claims in a court room. Because AppDetex are not the Copy Rights owner they would not be able to defend Apple Incs copy right in court, meaning you could sue AppDetex for loss of business, and yes I think their activity does break the law.

Good luck with that one. There are hundreds of companies doing the same thing. As tinsoldier pointed out, it's an emerging industry with many different enforcement companies competing to protect big brands online.

Apple in particular, you don't stand a chance against.

The enforcement companies aren't sending out official DMCA notices. I would think if that were the case, it would be necessary for Apple's lawyers to take the action. With the enforcement companies just sending out informal eBay VeRO requests, and eBay then complying in order to avoid becoming the next iOffer, I don't see anything wrong about that.

I mean, were you authorized to sell Apple products in the first place? :juggle:

I'm sure once it becomes more common, eBay will start vetting the vero accounts to ensure they're authentic.
