Hi. I am new to this site and would welcome your opinion regarding a dispute I have logged as a buyer with Ebay. I bought a motorcycle helmet that was described as in good condition with little use. The seller stated that there were two scratches on the visor. However; when the helmet arrived in a flimsy old crisps box (not good taken into account the helment should not be dropped and had little protection) it has an indentation of the flip-jaw and the inside of the helment was heavily soiled. It is obvious that it had been subjected to substantial use and was not as described. I purchased the helment as a life saver; it does not inspire confidence! The seller happemed to put in the advert the workd 'No Warranty' however, my argument is that the item was not as described and I would not have purchased it had I known about the damage and the overall state of the helmet.

What are my chances of this dispute being decided in my favour? I am worried.

If you payed for it through Paypal you can file a claim for item not as described. Paypal is all about the buyers and not the sellers so I am sure you will get your money back. But before filing a claim did you contact the seller and ask him about it? I would always try to communicate with the person who sold it to you first

IMO (In my opinion) 100%

The catch is you will have to incur the cost of return shipping with TRACKING.

Recently I filed a "Not As Descried" case against a seller and won the case, I then called eBay and complained about having to pay for return shipping on the item...

Believe it or not, eBay sent me a Pre-paid label to return to item.

Also I was reinbursed my total costs including shipping through the new program eBay has now, eBay Buyer Protection.
