first violation in 9 years-trademark ebay question
 
I have an account that has been open since 1999 and has over 700 fb 100% positive except for 3 old neutral due to slow shipping.

Today I had three items up for sale. I had taken all my own photos and used my own wording in the descriptions.

Now I just got an ebay message that two of the items have been removed due to trademark violations. It was a standard trademark notice from ebay. From what I have read on these forums, it is likely that a competitor reported me since it is a highly counterfitted item.

The third item is still up, and has nothing to do with the other items that were removed.

Now it says in my dashboard that policy compliance is "failing" and lists the one "trademark violation".

It just lists one violation for the two removed items which were similar items.

So how long is this "failing" status going to stay on the record? 60 days? I was reading this forum trying to find an answer but I couldn't find a definitive one.

In a few days, I am planning on listing another item which is a commonly replicated item, but it is not the same item (or same category) as the ones that were taken down.

I was listed as "good" before in the dashboard, but suddenly it slipped down to "failing" even though it says "fair" and "poor" in between.

So it looks like if someone reports another item they will suspend me??

How long should I wait before listing another common vero item? I do not plan to list the same items, or items like the ones that were taken down.

I personally would not list any other related vero items until the failing falls off. This happened to me and I relisted some other items and then BAM Im now suspended after 10,000 plus feedback. I believe a competitor did me in even though what I was selling was legit.

how long before the violation falls off?

and what about if it is a totally unrelated vero item? for example say I had a gucci purse taken down and now I am listing a dvd movie??

Those were not the items, just giving an example.

most people wait 90 days, you should wait 90 days

ok so if I wait the 90 days, could I relist the same item with a BIN and different pictures, title and descriptions than before?

I am sure someone will buy it, it had 26 watchers in three days and is a popular item.
