Limited Access and I have No Receipts

It is my understanding that Paypal added limited access to my account because the designer sunglasses I was selling are flagged as high risk.

They said I needed to prove that 1. The sunglasses were not stolen by providing a receipt/invoice 2. The sunglasses were not knock-offs.

I received the sunglasses from a store owner whose friend's sunglass store went out of business, therefore I nor the original store owner do not have a receipt/invoice. I told Paypal I could take pictures of all the serial numbers of the current sunglasses I have, but they said it was not good enough. Paypal said once several buyers confirmed they had received the items and their authenticity that they would review the hold, but I read online that unless Paypal can prove the items were indeed stolen or ⊗⊗⊗⊗, that legally they could not hold me money. I feel like they are stealing my money because they said I couldn't obtain it for 180 days and even then it would be under review once again?!?

I have been on the phone with them for 2 hours with several supervisors until they say they will not transfer me any higher. How do I get them to release it to me without going through the lawyers who handled a similar $9 million with them a few years ago?

1. Your account is toast. THere's nothing you can do but wait the 180 days.

2. You really get a bunch of sunglasses for free from a store owner whose sunglass store went out of business? Really? Truthfully?

If you don't tell us the truth, we can't help you... and when a situation sounds too good to be true... it usually.. and always is.

Saijin is correct.

I am not making any assumptions about the legitimacy of your items. You say they are real, and I believe you.

But, the fact is that PayPal CAN and DOES hold money for 180 days when they close an account. This is what you agreed to when you opened the account.

And, YES, they can close an account for ANY reason. It is called risk-management. They do not have to PROVE that you are selling counterfeit merchandise to do so. They SUSPECT your items MAY not be legitimate, so the account is closed, end of story. You will most likely get the money after the 180 days have passed, as long as the buyer does not request a refund or initiate a chargeback.

Contrary to popular belief, there is NO "right" to use the services of a private company. If a BANK - and PayPal is NOT a bank - wanted to freeze your money, they may only do so under certain circumstances as they are federally regulated. PayPal is not. Many people assume that they are subject to the same rules as banks, but that is simply not the case.

Sorry for the bad news.

Yes, the store went out of business about 4 years ago and the sunglasses have just been sitting in storage, so he gave them to me to sell on Ebay and I would give him a portion of the profits. I was willing to give Paypal all his contact information and to send them pictures of the sunglass serial codes and everything so they could see it wasn't a serial code from another store I would have supposedly stolen them from, but they said it wasn't enough, that I had to have receipts even though it was a locally owned store closed over 4 years ago and he doesn't still have the invoices? That is the truth.

I researched the legal case Paypal closed out of court paying over $9 Million to account holders they did this with and I found the number to the lawyers who sued them, and I'm waiting to hear back from them today. I also filed a claim with the Better Business Bureau. Do you think it would do any help if I also filed a police report for theft and faxed that and the BBB complaint over to them?

Might help not sure but the amount of time it takes to handle a court case and the amount it takes for them to research etc... by the times its done your paypal funds will already be almost ready from the 180 day release. Not worth all the the time and effort in my opinion.

Step 1. Go to your local Prada/Coach/LV/designer store.
Step 2. Buy similar sunglasses to what you're selling.
Step 3. Scan receipts.
Step 4. Fax receipts.
Step 5. Return sunglasses to origin. Receive money back.
