| | | HaniLeManiak | 02-02-2012 02:54 PM | I owe money to paypal I am canadian Hello, I had a paypal account for a year. I sold car parts to a local person and we used paypal to do the transaction (in order to keep proofs). The person did not bave all the money with him and I was offering him such a good deal that he absolutely wanted my stuff so we did 2 paypal transactions.
Later i closed my paypal account as i know that i will not need it anymore.
Later i believe the person claims that he got frauded and the credit card company reversed the charges. Paypal now wants to recover the money from me.
I am a canadian citizen and that nco group keep on calling me. I triend to contact the buyer and obviously the number is no longer in service!
What can happen? Thank you ! |
the collection company will take any actions to collect $$ from you if you owe them alot. If it is not much, then they just keep bugging you until they record it to your credit bill roll. |
| BiN4RY | 02-03-2012 01:04 AM | What I do not understand is why you would close your Paypal account rather than just leaving it? How would you know you will not use it again eventually in the future?
Also what cnmb said is correct. They will annoy you for a while and then it will go on your credits. |

How can it go on my credits? i don't recall putting all my info (no social insurance number, no driver's license, etc...)
I just pulled my credit report today, there's nothing showing that I owe them money. Also, it's paypal that approved the transaction and actually sent the money to my bank account. It's their mistake that they allowed the money to go through, not mine. They've been calling me for a month now... |

change your number | And how exactly does that save you from your credit taking a beating? |
1. A lesson to be learned is to avoid pa yp al when you can - fuggit.<
2. Sadly collection services suck but you may be able to settle for less than the amount.
3. How long ago did the charges get reversed? |

3. How long ago did the charges get reversed? | 1 - agree. sounds to me like this was his plan all along
2 - you can settle for less, but you will still take the hit on your credit. it will show as "account closed, settled for less than owed amount." |
| GreenBean | 02-07-2012 09:18 PM | Should I wonder why the OP thinks being Canadian gives him any exemption from a paypal claim?
I can so become a Canadian if that's true  :canada: |

| I *UNDERSTAND* that any adverse credit information placed on his credit file will only stay on file for x number of years before the slate is wiped clean again & any further legal action beyond this period is legally unenforceable on the collection of this debt ???
:ballchain:
PS: Please be aware that this is NOT legal advise but more to give you the boundary & context of this. I have broached this from the UK perspective though I am conscious you are a Canadian PP user.:nerd: |
| seanws30 | 02-07-2012 09:27 PM | no idea what the statute of limitations is on debt in canada nor would i ever offer any sort of legal advice. but here is some info for everyone if this ever comes up again:
Do I Still Owe After the Statute of Limitations Has Expired?
Even though the statute of limitations has expired on a debt, you are still legally responsible for paying the debt. However, the creditor or collector no longer has the liberty of using the court to force you to pay.
Why is a Debt On My Credit Report After the Statute of Limitations Has Expired?
An account may still appear on your credit report even though the statute of limitations has expired for that debt.
Are There Debts Without a Statute of Limitations?
Certain types of debt do not fall under the statute of limitations rules. A court can force you to pay these debts at anytime no matter how long the debt has been inactive.
What Can Restart the Debt Statute of Limitations?
Be careful about taking certain actions on a dormant account. You could restart the statute of limitations and give creditors more time to sue you.
When Does the Statute of Limitations Clock Start?
The crucial factor in figuring out whether the statute of limitations has expired is to determine when the clock started ticking.
Can a Collector Contact Me After the Statute of Limitation Has Expired?
The statute of limitations can help if you have to go to court over a debt, but it doesn't impact other collection efforts.
Can a Creditor or Collector Sue Me After the Statute of Limitations Has Passed?
The statute of limitations limits the amount of time you can be sued for a debt, but it's up to you to prove the SOL has actually expired. |
| HaniLeManiak | 02-08-2012 08:53 AM | So basically, I got screwed up by paypal? I owe them the money that they sent me?
Will they take legal actions?
How long will they keep on calling like this?
This is so ridiculous!
Do I get in trouble if I want to go to the US? (with the customs at the border or whatever) |
PP does this to folx all the time - they won't foot a chargeback.
The fact that NCO is calling you is PROOF that pp is NOT taking legal action - they have sold your debt to the collection service.
They will keep calling until you make a formal request to receive letter in writing or you speak to an attorney or you find a different solution.
/quote Do I get in trouble if I want to go to the US?
This isn't criminal matters so no. |
Speaking from past experiencing, I doubt paypal will sue you since it's way too expensive to hire a lawyer across the border just to sue someone (unless you own them million then it's a different story). However that being said, your credit will take a dent. I am assuming you are using your real info. when you sign on paypal, so have you speak to paypal about not able to reach the buyer? Speaking to NCO is useless unless you want to settle. I am surprise how many people doesn't understand paypal is not a bank and they will not protect you like a bank. |
PP wont sue since they have sold his debt to NCO Collection services. |

If you are willing to settle with any collector or creditor then PLEASE do not settle for less then the amount owed.
Always and only settle for DELETION of the trade line and in writing. |
Forget PayPal for a minute and that you are Canadian, eh
This guy stole from you. Fraud. So what if his phone is disconnected. I assume you got some details? He is local, no? File a police report
At the very least go after the guy....
Somebody steals from me the last thing I care about is a collection agency. Dont site on your hands asking "what can they do"... |

You have to take affirmative action about this claim of debt.
This is why you came to this forum yes?
We are not going to tell you to ignore the debt.
You have a collection company that 'wants' the funds of the debt.
You may or may not have made some silly deal with someone who you can not contact by phone. You should have other info about him. Home from Legal Line ® FREE Legal Answers and Canadian Lawyers Resource
Contact the above. They are Canadia  You should be given info.
Crossing the border into the USA is not pertinent to your troubles.
