Negative Balance after scammer
 
I sold an item to a buyer via invoice, and after it shipped he filed a claim. Long story short, I'm down a 2,000$ + item and negative that amount on Paypal. My bank account was linked, but not my social even though I was verified and had no sending limits.

How should I go about this? Can Paypal take me to court, or should I just ignore this account and start again?

PP can and will try to recover the money.

Did you not send the item with a tracking number?

Yup, I did. The buyer claimed it wasn't in the description as described, but I barely wrote anything in the invoice. The bank account I had on it was a prepaid card through GreenDot, and my old cellphone number. I'm pretty upset, if they take me to court I've got a great lawyer. I've given up on getting my money back, but I definitely don't want to pay court fees or a fine. Much less paying 2 grand that I don't owe...

Usually if an item is not as described PP ask the buyer to return the item.

Did the buyer return the item?

Nope. He gave me a tracking number that I'm pretty sure is ⊗⊗⊗⊗. Doesn't pull anything up on the USPS website. Sent it to me about 2 weeks ago

Have you sold to this person before via invoice or on ebay? How well did you know the person?

Paypal doesn't take people to court, if anything they will try to recover the money through Collection Agencies.

Whatever advice you get in the end it's up to you on what you do.

Are you sure that PP have refunded him, not just put the money on hold?

There is a pretty big difference between the two.

I've never sold to him before, and I know PP refunded him as my account is completely negative. I actually transferred the money into my bank account a few days after the transaction.

All I have on this guy is his Paypal and email address. I'm going to call PP and see if I can figure it out even though they closed the ticket.

If the tracking number is bogus, phone up Paypal (or send an email through their webform) and say that. They'll get it changed for you.

Also, it's not a case of paypal taking you to court, you should be taking them to court. They never, ever risk it and will always back down - even for $2000. If you have a good lawyer, get him to write to paypal for you.

was there a paypal case? did the buyer upload a tracking number via the system?
