Even this was a normal payment method op stated that this was over a year .
So no luck anyway under these conditions ..

Forget getting it resolved with PayPal. If you still have records of any agreements on facebook that is any form of a contract, save copies of all of the messages and look into taking them to small claims to get your money back.

Take them to small claims court. Get a judgement and if its in your favor then take it to the high court and get a high court writ. You can then force them to repay you.

Its not expensive to go through small claims and only takes a few weeks.

Small claims, then to high court like James says, if you have proof it was a loan.

Just remember they need some way of repaying. That 1.5k debt is going to sky rocket with court fees and bailiff charges. If they have no cash or other assets to pay with would you be willing to potentially peruse it all the way? Bankruptcy, frozen bank accounts, house sale etc…? It’s a side of it some don’t always imagine.

Of course, if you think they have the means to pay and they are just being d*cks then go for it.

I agree with a lot of what others have said. PayPal is unlikely to take your side, this is more a matter for a small claims court. If you feel they do have the means to pay it back but aren't doing so, then I'd pursue it further.

My only concern is you may not have much success. Whilst you have everything in writing, what you don't seem to have stipulated is a term for repayment. Things like "repayment when they sort their life out" can be loosely interpreted, and as a plaintiff you may not have much grounds for a repayment. In future, always state a term for repayment, i.e. within 12 months.

I'd speak to a lawyer for more advice. An official letter from your solicitor, delivered by post, may help push things along with repayment without having to pursue it further.

Sadly, PP isn't going to help you. I do think you can go to small claims court and probably win.

The question isn't whether you can win, it's whether you can collect. They're probably what we call here 'judgment proof', meaning even if you win there's nothing there to take to fulfill the judgement.

In the US if you get an uncollectable judgment you often can deduct it from your taxes. Maybe you can get some offset for it in reduced income tax. at least it won't be a complete loss.

And in the US you can lien them and judgments are good for seven years and renewable for even longer.

If they EVER get anything of value later on in life you may still be able to execute that judgment even years down the road.

And you maybe can lien their property if they own or are buying their home. you said they have a mortgage. That way they can't sell the house, ever, without paying you first.

Speaking to Paypal they say I have no recourse and the Police would see it as a civil matter. As I've sent the payment as friends and family which is a (GIFT) payment, legally have I not broken Paypal's rules and a small claims court or actual court would not help?
