Hello all, i have a an issue with paypal by blocking my purchase i wanted to do on ebay.
My issue is, I bought some paintings from a seller and when i got three of them appraised thr prices were, $30k and other $30,350 and my large oil on board $200k to $300k.

My law suit with ebay is about 2 oil on baord paintings andn 8 watorcolor paintings with an possible appraisal of $500k. I am now in contact with the seller and my appraiser to prove my loss of opportunity from PayPal blocking my account via "declining all 33 attempts to pay with a screenshot of my ATM balance to prove I can afford it the purchase. I also have many prior purchase from this seller with good feedback. PayPal informed me that the block and or declined payment is automatically triggered by the "system", whatever the F that means. Because I wasn't able to bid I lost the items i wanted to buy.

Note:
I am currently selling 3 paintings with COA and appraisals over $100k in auction f4om same seller.

Do i have a law suit for my loss of opportunity and financial damages

Im no lawyer but I highly doubt it.
The simple thing to do would have been to use a different payment method - and there are plenty of them out there.
Quite frankly Im shocked the seller agreed to accept paypal to begin with - I know I wouldn't. Not with those amounts involved.
You accepted Paypal's ToS when you signed up and its pretty clear from those that they can refuse you service for ANY reason.
You can try but Im pretty sure youll be wasting your time and money. This sort of case will require a lawyer - which means paying upfront. Maybe consult one before you proceed. Hed know far better than anyone here anyway.

Geeezus, why are you using PayPal for these kinda of 5-figure transactions in the first place?

Anything over $10k would involve at the very least an alternate (and more secure) payment method.

I paid far less (under $2k) per painting. however, they turned out to be rare paintings by the master painter which are worth far more (estimated appraisals as mentioned) but PayPal blocking me while im in good standing and have many transactions with the seller makes ni o sense. I am consulting a lawyer after i save $5k retainer

I'm not taking PayPal's side, but there are specific reason(s) PayPal is likely blocking these transactions and I'm sure it's outlined in their AUP.

my problem is PayPal wouldn't unblock and or can't even override the transaction. That leaves me stuck. When sellers way of payment is pnly PayPal im screwed, now PayPal will answer before a court. I tried paying another debit card/ credit card, with no other alternative other than a direct payment which goes against ebay terms. leaves me &#$&$. I am creating a new platform called DOMAINTOBE.COM and. will resolve all these BS isues with the payment gateway methods and alternatives. I've worked on it for 2 years now ready to launch very soon. Im sick of eBay and PayPal.

So you are saying the funds are still tied up with PayPal, they still hold your money and the seller has yet to receive the funds?

Did you use a CREDIT or DEBIT card as your source of payment?

If this is the case have you contacted your card issuer?

no. they wouldn't and or couldn't allow me to pay. payment was declined automatically. using all available payment methods that i could use. I lost out on buying the paintings because of there auto block (as they said) and couldn't reverse the system. It was #^#&#& for over a week and now the items are sold. My loss? hell no. Will be PayPal loss soon.

I know this is very frustrating for you. We all had similar situations with the inability to pay using PayPal every once in awhile.

What does your seller say? Can use use another alternative form of payment?

That seems to be the most logical solution at this point in time.

only PayPal. That left me stuck. My alternate payments and him only accepting PayPal resulted in my loss of opportunity

if he is selling such high ticket items on a regular basis,he has t o be a pro-aka a dealer,cant imagine he does not have a merchant account to accept credit card?
But the fact Paypal blocked you may make him leary of doing business with you?

You have no case here, end of story. Many reasons as to why that is. Hell even most stockbrokers are not liable if their platform has issues and you lose money.

Paypal sure is heck ain't.

I also find it very hard to believe you are buying paintings for 2k and selling them for 100k or more. That is bizarre.

Can you explain that more? Who is this seller?

don't you make $1000's a day selling electronics? you've lucked up so why is it hard to believe that this guy got lucky as well?

A legitimate seller/dealer in fine art/collectibles (especially one dealing with appraised items in the 5, and 6 figure sums) wouldn't only be using PayPal as payment.

Something doesn't add up here.

OP, although we sympathize with your problem, you really don't have a case here.

This is an issue with your seller, so I suggest you focus on them instead of dealing with PayPal.

That there is the root cause. Average outgoing payment is $2,000. Then all of a sudden it spikes sporadically. Red flags go off. PayPal blocks the payments. It's as simple as that.

You should of called in and tried making the payment with an operator on the side pushing the payment through. With large transactions that's your best bet.

I don't think you get it.

Paypal and eBay give people the boot off their platform just because they think that person is not worth the trouble. That's why THIS forum exists, to get us back on the platform.

What makes you think you can sue them because their security system prevented you from paying for an item ?

Don't waste your money on a lawyer. Carry on looking for your next opportunity and since you buy from this seller so often, may be suggest you are prepared to pay via bank transfer after successfully winning one of his auctions.

If you want to be further out of pocket go ahead.

Something about this all seems a bit fishy to me though... PayPal are not required by law to offer you a service. Much like if you go into a bar and want to have a drink they can refuse to do business with you if you wish. You cannot then turn around and sue them because you wanted to buy a pint for $2 and sell it for $4 outside the pub.

If you were paying just $2k then that really isnt a bit transaction by PayPal standards so for them to refuse it, it means something has been flagged. It will all be covered in the TOS. You will be wasting your time and money.
