Default paypal dispute taking longer than expected

So I opened a dispute for not receiving item. seller has been responding to every email, but he wont refund, saying he sent. he has no proof, no tracking number.
I received an email from paypal today, saying the resolution is taking longer than expected, blah blah
i thought this was a pretty simple case, seller has no proof, buyer wins. i am worried about whats going on, i am worried that maybe seller will win, then i will be screwed. any ideas what they are doing?

They just want to wait a couple more week to see if it arrives.

Did you escalate the issue already?

Is that email from paypal wrote by a real person or auto generated msg?

yes i already escalated, I am not sure if its by a real person, its difficult to tell.

normally there is a name down close to the end of the message.
