It clearly says in the user agreement that a buyer has up to 45 days to open a claim. He opened his claim after 60 days for $400.00 this is a clear breach of their user agreement. I called PayPal yesterday and stressed that this case was opened after 45 days and I told them their policy and she shrugged saying maybe there was an exception. No, there was no exception when I was banned for minor reasons was there?! Staa said that there is no way to talk to the appeals department because they don't answer the phone. My question is what are the chances that they will give the buyer their money back? And can they just breach their own user agreement?? Wouldn't I be able to threaten legal action?

My mother had sold something in August last year and someone did the same thing in February and she added all tracking information etc... and they still gave the buyer the money back.:faint:

So i would say, yes they will probably go in the buyers favor.

The chances are very good for them to get their money back and 100% if they paid buy credit card. If they file a chargeback with their CC company paypal automatically refunds and charge you an extra $10 for the pleasure. Is your account negative? If you want to keep the account you will have to eat it.

What kind of claim is it? A paypal dispute or is it a credit card chargeback? Did they give you any reasons?

OP, pull your head in and stop comparing your history to what another buyer managed to do. In the cold hard and harsh facts of day they will be different.

Fact of using paypal.

They have GUIDELINES. They can apply them as they see fit.

Now that is outlined for you, what the actual story of this belated claim?
How can you best defend it?:argue:

In no way do I think it fair. It is an example of paypal's unreasonable behavior.:fight:

I had one for more then 60 days in January.

PP continues to screw sellers over and over.

It is so sickening how they operate.

I've heard of this on the Ebay forum. The thread might still be up. Someone returned a used coffee maker they had for a few months (can't remember how long). Paypal made them take it back and gave the buyer a refund.

It took a long time but the seller got the money back from Paypal.

It's insanity.

I had this same problem 9 months ago when I sold 2 hard drives to two different people.

The 1st case was 67 days after the sale, the buyer was able to open a case with paypal about the hard drive having bad sectors and not being new. I uploaded my invoice from Western Digital on the hard drive. I test every drive I get and it tested new. In the end, paypal said the buyer had to ship the HDD back to me to get a full refund.

When I received the hard drive, I checked the drive out and had over 50% bad sectors, it was unusable. I had to sell it for parts and only got 5% of the original price.

The 2nd case was just after this one ended and it was 51 days after the buyer bought it. I was lucky in that the buyer did not use it and and just wanted a refund. I was able to sell it new and sold for 95% for the original price.

So ebay and paypal never go by their own policies. I will never trust them in my life.

I've just had a case opened in EB at 80 days. Buyer has ner contacted me and its only for $5.These people really annoy me.

I have written to eB asking them why they are allowed to break their policy, we'll see what they say - probably some generated crap.

Case won't go against seller performance and they'll look into it so its doesn't happen in the future.

i had a very high activity paypal account. someone tried to scam me and about 4 months later filed a 'unauthorized charge' chargeback with their credit card. i had all the proof that i did everything right. paypal sent me a message that since i did everything right they would give me back my $ at their expense. it was about $450. just saying...
