Chances of winning this potential SNAD case
 

I have this annoying guy who purchased a new garment from me a month ago and is now complaining the stitching has come undone and the collar is starting to show wear bla bla bla after 10 times being worn.

Fortunately he has already left positive feedback.

Anyway I have offered to pay for the stitching to be repaired locally if he attaches the receipt. But he is complaining about the collar, the tailor says it can’t be repaired bla bla bla.

I have sold 7 of these pieces, no other issues. I have one myself, no issues.

He seems to want a refund and I am fearing a SNAD case. I don't want to have to accept a worn garment by some idiot and have to refund.

I have another 12 days to get past the 45 day ‘safe line’ to avoid PP.

I assume PayPal is most likely to side with the buyer in this instance?
But when I read the SNAD terms I’m not sure which one it would fall under for him?

It seems more likely the terms favour me, specifically the one in red.

Any feedback or comments are welcome.


13.7 SNAD Definition
What is Significantly Not as Described (SNAD)?
An item is Significantly Not as Described if it is materially different than what the seller described in the item listing. Here are some examples:
You received a completely different item. Example: You purchased a book and received a DVD or an empty box.
The condition of the item was misrepresented. Example: The listing said "new" and the item was used.
The item was advertised as authentic but is not authentic.
The item is missing major parts or features which were not disclosed in the listing.
You purchased three items from a seller but only received two.
The item was damaged during shipment.


An item is not Significantly Not as Described if it is materially similar to the seller's item listing description. Here are some examples:

The defect in the item was correctly described by the seller.
The item was properly described but you didn't want it after you received it.
The item was properly described but did not meet your expectations.
The item has minor scratches and was listed as used condition.

Depending on price (If cheap) refund, block and move on.

If its a significant price, tell him/her to send it back and once received, give a refund.

While the garment cannot be used/worn, the person seems to want to get a free item.

$150.00, I do not want to refund and take possession of a worn item.

My question is related to the likeliness of him winning SNAD case (In the event it's opened), as I cannot see any clause which covers his complaint.

I don't this he is a scammer, more of an idiot.

He will win period if he files

Do not let anyone here or ebay or paypal tell you any different again you will lose!

He will get a refund once he sends back whatever the heck he wants

It's impossible to win a SNAD case.

the best scenario will be you demand him to return the goods to you and refund.

9.9/10 times you will lose

The only few PayPal cases I have had were SNAD, and I've previously won them all.

Case 1: Ring doesn't fit. Size stated 3 times in the listing, twice in bold. Measurements listed. > Won

Case 2: Not authentic bla bla bla > Buyer could not provide documentation to prove claim > Won

Case 3: Size of garment is not really a large > Measurements stated in bold size 16 font and description stating slim fit > Won

Case 4: Pre-owened knit with some light pilling described in underlined bold > Won.

I'm going to ask him to return it to me for repairs here so I can drain things past the 45 day period, then return it back to him as is, I can't be bothered dealing with this moron any further.

I was able to get past the 45 days fortunately.
This account has never had a SNAD.

I don't know what's going on lately, but the past month there appears to be an increased amount of idiot / morons on eBay. I cancelled over $600 of bids last week in an effort to avoid dealing with potential idiot bidders, but unfortunately some sneak past.

The blocks / filters are not strong enough.

Said filters have not been strong for quite some time.

Most vexing.

Always need to fall back on Plan B or Plan C

Well I've always tried to vet most bidders, just lately it seems more and more are either risk prone (ie: leave excessive of negative / neutral feedback, non payment history, potential non receipt scammer) or just the generic idiots that don't read listings then expect to return / refund.

I wish we had the kind of filters available to us that PayPal have. Read flags for every little thing.

Confirm identity and address. Confirm ability to pay for item(s). Confirm you have read the damn listing. Confirm you are a size L.
