paypal appeal
 
I purchased an iphone from a seller on ebay who asked me to pay through paypal direct due to some issue with the checkout address.
I foolishly paid from paypal but to my horror I received a damaged iphone.
I opened a case with paypal and returned this iphone back to the seller.
Upon receiving the iphone back the seller said this was not his iphone and appealed to paypal.
Now after a full week paypal actually decided in the favor of the seller!
I am really shocked because paypall never asked me to provide any additional evidence or anything!
Now this seller has both the iphone that I returned plus my account was debited the full payment!
how can this be... what should I do??

You are been literally scammed by that s***.
The problem is that you paid him directly, afaik reading your post.

You mean the seller asked for the transaction as off ebay but via paypal?

Exactly. I suggest you to contact paypal by phone explaining what exactly happened and they can change the end.

Yes exactly I paid him directly through PayPal because initially the apt# got left out from the eBay checkout so I he refunded and asked me to pay gain directly through PayPal. I am really shocked how PayPal could not only give him his item back but also give him my money! So horrible!

Did you pay via CC? If so you can take this up with your CC company.

Exactly as James stated - you can claim with your CC for fraud.

Also press back to PP that you were deceived...they can see that seller asked for payment off of eBay

The thing is that my paypal had insufficient balance so my payPal is currently negative balance and they are demanding I pay them or else they will limit my account. My pp has a gift card linked with no balance so in order to pay that negative balance I will have to link my credit card. Sô eventually my credit card will be charged. But I don't want to get tangled in a huge mess....

Yes I actually gave a donation last week to some charity and that used up the funds

Seller is ignoring all my emails. I am considering filing a police report. Does anyone have any idea what becomes of a police report.

You have to contact his local sheriff and PD.

Most reports unless it's a lot of money won't come out of anything.

But call his local PD and see what they say. It is very difficult in this situation.
There was a minimum of $500 for reports. Anything lower than that they usually don't even bother.

When you call them ask if there's been any history of violations on that person in his county and if there is, you can try to persuade the cops to take a closer look or pay them a visit.

the item was $190 valued, do police regard ebay cases as civil?
also Im from east coast and the seller was from California.

One last thing is the account was stealth with stealth name how would I get a police report in such a case? Also if the item was less than $200 would the police bother?

no, you did not think clear with your actions, and you were naive. If you told the cops you used a stealth account, they would forget about the iphone case and press charges against you. Believe me do not trust police, they are there to get results and nothing more :)

IMO...you got screwed and short of going to their address, I think you have to chalk this one up to a learning experience........or buy some cheap stuff from different accounts and shotgun him with negatives...and file cases on everything........bad news for sellers to get many cases filed these days.

Ok everyone thanks for the advice. I doubt the cops would do anything helpful for a used phone under less $200 anyway. Maybe I'll call up PayPal again and appeal.
