rock45 | 10-29-2008 08:36 AM | paypal dispute in progress. scammer? i purchased a supermarket gift card from ebay 10 days ago, about 500 AUD. i asked the seller to confirm with me that he has my correct address after i made the payment via paypal.
2 days later he replied that the card has been shipped to my address on that day.
normally it should only take 3 days. it has been 10 days now i still not receive it yet.
i sent him a message the day before yesterday, no reply from him.
i filed a dispute tonight. 2 hours later i got his reply via paypal and also email updates from paypal:

* 29/10/2008 22:01 AEDT - PayPal: Buyer escalated this dispute to a Claim.
* 29/10/2008 22:01 AEDT - Seller: GIFT CARD WAS SENT LAST WEEK BY MY MISS AND HAD BEEN SENT VIA ORDIANRY POST I STIPULATED IN EBAY THAT THERE WAS NO REFUND GIVING AND ITS NOT MY FAULT AUS POST IS OUT OF MY CONTROL
* 29/10/2008 21:50 AEDT - Seller: aus post might had lost it sent last week, no refund giving in description you should had asked for registerd post!
* 29/10/2008 21:31 AEDT - Buyer: been 10 days, still not received the card yet. domestic post should only takes 3-5 days.
i didnt ask for registered mail because another potential buyer asked him before the auction end:
Q: Hi, Does the $11 include postage by registered mail? 17-Oct-08
A: opps sorry the postage is free just got to change it
so i supposed he would post it via registered mail.
(whom would post a 500 AUD gift card without a registered mail !!!!)
in addition, he stated at the payment instructions :
Seller's payment instructions
PLEASE PAY 2DAYS AFTER BUYING.
Refund will not be giving
thankyou
so that's his argument:
1 i didnt ask for registered mail thus he is not responsible for the lost during post via regular mail
2 he clearly stated no refund will be given.
just wondering you guys ideas. what do you think the outcome from paypal. |
