paypal dispute in progress. scammer?

i purchased a supermarket gift card from ebay 10 days ago, about 500 AUD. i asked the seller to confirm with me that he has my correct address after i made the payment via paypal.

2 days later he replied that the card has been shipped to my address on that day.

normally it should only take 3 days. it has been 10 days now i still not receive it yet.

i sent him a message the day before yesterday, no reply from him.

i filed a dispute tonight. 2 hours later i got his reply via paypal and also email updates from paypal:

Status

This item not received dispute has been escalated to a claim.

We requested additional information from the seller about this transaction.

What happens next

The seller has been asked to respond by 8 Nov. 2008. Once we receive the information, we'll continue our review of this case.

* 29/10/2008 22:01 AEDT - PayPal: Buyer escalated this dispute to a Claim.
* 29/10/2008 22:01 AEDT - Seller: GIFT CARD WAS SENT LAST WEEK BY MY MISS AND HAD BEEN SENT VIA ORDIANRY POST I STIPULATED IN EBAY THAT THERE WAS NO REFUND GIVING AND ITS NOT MY FAULT AUS POST IS OUT OF MY CONTROL
* 29/10/2008 21:50 AEDT - Seller: aus post might had lost it sent last week, no refund giving in description you should had asked for registerd post!
* 29/10/2008 21:31 AEDT - Buyer: been 10 days, still not received the card yet. domestic post should only takes 3-5 days.

i didnt ask for registered mail because another potential buyer asked him before the auction end:

Q: Hi, Does the $11 include postage by registered mail? 17-Oct-08
A: opps sorry the postage is free just got to change it

so i supposed he would post it via registered mail.
(whom would post a 500 AUD gift card without a registered mail !!!!)

in addition, he stated at the payment instructions :

Seller's payment instructions
PLEASE PAY 2DAYS AFTER BUYING.
Refund will not be giving
thankyou

so that's his argument:

1 i didnt ask for registered mail thus he is not responsible for the lost during post via regular mail
2 he clearly stated no refund will be given.

just wondering you guys ideas. what do you think the outcome from paypal.

A bad deal for you.
Why pay $500 of your own hard earned money to some ebay seller for a card?
There are other choices for Australia that are much safer.
Why did you not ask the seller to put in writing the conditions of the sale. There is one mistake and you 'assume' you will be OK.
If your post is not a copy of how the seller made his listing are you old enough to have made a contract in the first place? Did the language not give warning bells?Think of it like this,I give you $500 for a card and I have no rights if
anything goes wrong?A hellava lot of money to lose. You do not do business like that. How was the money paid? I need much more info about this, please.

A big problem is that the question is beyond what the forum does.

thank you for your post GreenBean

the money was paid by paypal from the balance (i earned from ebay), not from my credit card or bank transfer.

i shouldnt made such mistake - -

now paypal's asking him for some kind of information, and will decide on 8th.

what i can do i just sit and wait

AUS might be different the USA, but if he does not provide them with signed delivery confirmation number showing delivery, the buyer usually wins. However, if he cleared out his account and they have no way of getting any money out of him, you are out of luck.
