Hello everyone, I am wondering if these items would be seized by customs. I would be using DHL Express for decent sized orders:

SNES USB gamepad:

Gameboy Color Cartridge Shell:

I have seen the photos in the description and contacted the sellers. It looks like there are no Nintendo logos on any of the products, everything is just blank. The closest thing the gameboy cartridge shells have is "GAME" on them. Would these items be seized by customs? I do not want to import anything illegal. I think all of these would be ok because there are no logos on them but what do you guys think? Thanks!

They look generic as far as I can see which means that they should be fine

So customs is only looking for branded logos like nintendo on them? I just do not want to order a ton only to know customs just seize them because they "look" like them, despite having no logos. Has that ever been an issue? Or is it only seized because of a logo? Thanks!

You would need to talk to a copy right lawyer RE that I am not versed enough in it to give a solid answer.

If its looks 99% like the real thing minus the logo though I could see customers having an issue with it, but that is speculation on my part.

Yes, your copy rights lawyer.

As a potential seller, you need to do all the homework.

If you get an incorrect response, then Customs are still going to go after you.

So I can get in contact with any Copy rights/intellectual property lawyer and just explain the situation? And if he says its completely legal, but for some reason Customs think otherwise, then what? Want to do it as smooth as possible.

you see, customs is the ultimate decision maker. they might think you are trying to fly under the radar and then add logos later to pass them off as the real deal. you aren't going to be able to dictate jack shxt.

Yeah that is why I am trying to figure it out before I go through the process of ordering. They might think that but an original NES cartridge has this on the back:

Raised impressed Nintendo writing, which I feel would be far difficult to pull off exactly like it. Then again, no idea what goes through the thoughts of people inspecting at customs. I feel like the fact that the product is from the 80s, would it still be as critical as say when they are cracking down on BEATS or DVDs?

the brand and design still sells. that's why people keep bringing back modded systems and emulators. hell, look at the retro SNES that's been selling out.

the truth is, the product you want to import is designed to look as close to the real thing as possible without getting stopped. it wouldn't sell if it has a completely different design. it sells because of what it is designed to imitate. if cust.oms feels you are a risk, then it's getting stopped and you won't be convincing them otherwise. these people aren't moronic TSA employees.

it's one of those things you will just have to be ready for. import small and see if you can survive but be ready for the worst. no one on this forum is going to be able to guarantee you that cust.oms is going to let you do whatever you want.

yea it says nintendo . that would be branded would most likely be gone if inspected

If you check the first and second post for the pictures (specifically the NES cartridge shells), they do not have any Nintendo logo or brand on them they are blank. If customs inspected them would they still be gone?

You really need to talk to a trademark lawyer.

We are just guessing here based on our own personal experience. A trademark layer trained and paid to know these things with a much much higher level or certainty

No I understand that completely, I am looking for everyone's personal experience if they had one or not in this type of area for customs, like generic items. I am assuming you have to make a paid consultation with a trademark lawyer?
