Box of Genuine Items Seized by Australian Customs
 

Hi, just wondering if anyone has any advice please.
I import genuine brand name childrens clothing. They have small faults (e.g. slightly marked) and are rejected by the brand owner so I buy them at a reduced cost and resell for a small profit margin.
I recently had a box seized by Australian Customs. They have sent me a letter stating the items are an infringement of copyright. However I know the items are genuine.

Should I just agree to have the items destroyed as I am worried about any legal action? Can the brand name owner take action against me as I dont have a licence to import their brand name? there are around 60 pieces of clothing in the box.

If you know they are real, then why are you freaking out? All they want is proof they are real. If you cannot prove that legitimately, then ignore the letter.

The real question is are you authorized to import that stuff? genuine or not you still need permission from rights owner to import ANYTHING without having to worry about customs.

Welcome to the forum. If they are genuine, I would fight it out...if not...well unkown is right on about this.

I am sliding with unknown's view on this as well.....

The original stock reseller where the Op sourced these goods from would have stated on their resale terms whether there were any import/export restrictions &/or any other prohibitions/contra-indications like requiring an export license.

I would contest this & supply the Australian Customs the invoice purchase order documentation to vouch for their legitimacy.

I would be interested to know the outcome of this.
