All you ⊗⊗⊗⊗r dealers gonna get a can of lawyer woop ass, they gonna track your stealth asses down and put you in jail lol.


A new section 6.b. has been introduced in the PayPal Privacy Policies.

PayPal has to disclose account information to intellectual property rights owners if, under the applicable national law of an EU member state, they have a claim against PayPal for an out-of-court information disclosure due to an infringement of their intellectual property rights for which PayPal Services have been used.

“b. Disclose Account Information to intellectual property right owners if under the applicable national law of an EU member state they have a claim against PayPal for an out-of-court information disclosure due to an infringement of their intellectual property rights for which PayPal Services have been used (for example, but without limitation, Sec. 19, para 2, sub-section 3 of the German Trademark Act or Sec. 101, para 2, sub-section 3 of the German Copyright Act).”

I have no idea about this sort of stuff, so forgive me for being naive. But...

Isn't that different? They have a claim against PayPal for an out-of-court information disclosure due to an infringement. They don't have a claim against the each and every bank for the same thing do they?

Or perhaps I need to go and look at all my bank's T's & C's.

Paypal may well disclose the financial infornation eg bank info as well as name and address but I have not read the policy in any detail.

Selling counterfeit goods is a criminal offence so the police, if involved, could easily get the real name and address details from the bank.

My point really is that using stealth accounts does not mean you can get away with selling knock-offs. The authorities can always find you if they are so inclined.

Exactly, the idea of a stealth account is purely to enable people to sell on ebay again after being blocked for some reason. The stealth account is not a means of selling dodgy or counterfeit goods as there is nearly always a way of tracing the seller back to base.

My guess is Paypal may reveal Bank Account details to an Intellectual Rights Holder, however only the Police will be able to obtain the real name and address from the Bank as part of a criminal investigation.

This is what I assumed. So would probably depend on the severity of the case/persistence of the right owners

Selling counterfeits was illegal before this legislation and its still illegal now.

Don't sell counterfeits and its not really an issue

The wording of this legislation doesn't mention counterfeits specifically. I get the impression this gives right's owners the ability to pursue unauthorized retailers of genuine products as well as counterfeit peddlers. Those on Etsy who use trademarked logo's without permission could also be targeted.

I was just about to say that: surely selling ⊗⊗⊗⊗ boohoo stuff was against the law before, so nothing has changed.
Now they just have more power over some of the "personal" information and can actually enforce the law finally?

To me, that's a good thing- The better the reputation of the marketplace in the eyes of a potential customer, the better it is for legit sellers.

I was gonna say the samething yesterday then I remembered the legal letter that slipped through my door cause of an item I was selling on Amazon, this was years back. The issue was that a retailer sent their lawyer after me for passing on their name in an item I was selling. It was a genuine listing but I found a close match name of similar item to describe mine. Not in a million year would 90% of sellers think this would be an issue. Infact, I only had a single quantity of that item. I could have just dismissed the letter but because I was selling under my limited company name, I had to do something

This wasn't just any letter, it came in 2 large envelopes and each was a bunch of like 20-page document. At first I froze, them I composed myself. I called up the lawyer to apologise, and all was resolved with that phone call.

Back to ebay. Yesterday, I wanted to say it is a non issue if you don't sell counterfeit but I think its still an issue for genuine sellers if you don't thread carefully

Yes, Paypal changing their rules to give out info is one thing but going to the bank concerned to ask for the real address i doubt that would be as easy.

Whatever i think the days of endless empty VERO threats may be coming to an end.

Nothing will change under eBay current rule right owner still can get information about seller,
I am Vero registered member with eBay and once I report item to eBay once they took action I can request seller information.

So don't think anything will change
