Default Return lost by royal mail (tracking has just stopped) who is responsible?

Royal mail have lost a return (automatic 48 hour tracked issued to buyer by ebay) Its just stopped updating. Royal mail are beyond unhelpful. Who is responsible for this? Ebay issued it, the buyer sent it and the seller still hasn't had it? Whose burden is it to chase it? bearing in mind 48 tracked compensation is £100 and the item is far more

Who should undertake the burden of chasing it is open to debate.

IMO, it's up to the buyer, they are the ones who have the 'contract' with ebay and Royal Mail.

In the event of a non-delivery dispute ebay will almost certainly side with the seller, they've done their bit.

that is what i'm looking for, "in ebays view" as that is all that really matters


thanks for your response comes to something though when ebay are issuing labels that don't even cover the value of the item

AFAIK the law actually says that if the buyer can prove they've posted the item then it becomes the responsibility of the seller, and why I said it's open to debate because I'm confident ebay will not make the seller refund and the buyer would either have to push ebay for a discretionary refund or, failing that, seek redress via the legal system.

I can't comment on the insured value issue, it's not something I've come across but by the letter of the law based upon what I've said above, the buyer could argue the value is not their problem - although I'll guarantee that's not the reasoning behind ebays return label policy.

It has happened that if the buyer kicks up a fuss, they will refund them out of their own pockets and not hold the seller accountable.

Well i'm glad to hear if pushed ebay should take liability. They charge enough in fees. Does anyone know the time limit before they will take it on? royal mail consider 10 working days lost.

It sounds like a high ticket item.
Just because Ebay provides a return shipping label,it is not responsible for the missing shipment.unless Ebay owns the carrier.
Buyer should take it up with Royal mail.
If this is USPS,then it will try to track down the package,if it is lost,and not insured,then it is too bad,for the shipper

If this were USPS ,I would call 1-800-USPS customer service,their internal tracking has more details than what we see on its website and will pinpoint why it stops tracking and where is the package .

So long as it's showed as delivered then 95% of the time ebay will issue the refund themselves.
