What could a buyer do?
 

I received an email from a buyer questioning the autheniticity of some dvds that I sold him. I guess some of discs don't work. This is the first time that I have had a buyer question if they are real or not lol. I went ahead and emailed him back and said that I get them from the same supplier that the power sellers get them from.

My questions is, If a buyer questions the authenticity of an item, can they sue you for selling them a replica? Also I was wondering how sellers get those lawsuits from companies? Is it because buyers contact the companies themselves or do the companies go undercover and purchase stuff from Ebay? :pop2:

Yes they can sue, but for a few DVD's it probably wouldnt be worth the trouble. They would have to prove that they were duped into buying them, and even getting ahold of you would be too hard. Not to mention the time and court fees it would cost would make no sense. Just be prepared for an item not as described dispute and that you WILL have to provide a refund to them as Ebay screws sellers out of everything.

Don't worry about it, no one is going to sue you over some DVD's. It's not worth the hassle. If they're not satisfied, just have them send them back, refund them and resell them.

In America, you can be sued for any reason at any time by any one.

A lot of people threaten by email. I had a guy who told me he was going to come to my house and "kick my head in"

I said "hey i will look forward to seeing you" "I will clean my rifle in anticipation of your arrival"

I was very dissapointed to find he never came.

Who can read the mind of a buyer? Depends.
Take downs happen by different methods. Depends on the item. Several vague reports of companies going under cover. There's no firm definition.
That said you have to be aware that there are Federal laws against selling replicas. Not anything to laugh at since you suggest you know what the items are.

Definately nothing to laugh about, but when everyone is selling vero and buying from dhgate.... what are they going to do, throw a million people in the slammer :noidea:

There was a story that I watched on Forensic Files. It was about an 18 year kid that was selling cb radios online. They didn't say it was ebay but I'm sure it was. They went on to explain that he was doing the ole switch & bait. Advertising brand new $400 radios & then sending cheap $100 radios. Well one customers was super pissed, he was calling non stop. The kid just ignored him. Well the outcome wasn't good & the angry customer sent a bomb stealth mode but he got caught because of the forensic evidence.
