being stiched up?

hi guys just wanted bit of advice here.

i bought a item off ebay but after buying it the seller said he no longer has item. i sent someone along way to pick item up so i was not too happy about.

the guy who was suppost to pick the item up for me was reccomended by the seller .so stupidly i agreed for him to pickup and deliver item.

the guy who was suppost to deliver item is now claiming he delivered it to me yet i did not see a thing!! think in truth he may of been related to this a**hole seller. thats why the seller he reccomended someone he knows.

the seller then still asked for payment through paypal. i said im not paying for a item i dont have. but he still sent me money requests through paypal.

i then asked him to cancel sale on ebay which he did. but he still sends me money requests i still said im not paying.

to cut a long story short hes contacted paypal and they said this

Thank you for contacting us regarding the buyer of the
item you listed. I understand you're concerned
as your buyer didn't pay for the item after they received it.

Since the buyer has the item, you can report the buyer to the police.
We're happy to help with the investigation if needed - police officers
can email us using the 'report information to eBay' link on this page:

is there anything this a**hole or ebay can do. I dont want to get chucked off ebay for a item i never had. the sale was canceled on ebay but he still reports me & sends me money requests.

I believe in this case ebay has washed their hands on this one. By telling seller to deal with the cops, its their way of saying to him "you're on your own"

1. He has no proof of delivery
2. he has canceled the sale on ebay

Whatever his little scam was, it was not well thought out.

You are free and clear as far as I see.

If you do not have the item you are good. If Paypal/Ebay look into the Sale they will see that HE Canceled the Sale for whatever reason he told them. So how can Anyone expect YOU to have the item?

Do not worry, Ebay and Paypal ALWAYS side with the Buyer, even when The Buyer is DEAD WRONG. In your case you have NOTHING to worry about.

Standing back (sitting really) it's your word against his. You could have used ebay buyer protection on the grounds of item not received. Cancelling the sale will be regarded badly for you.

It is a stitch up. He'll have done this before. What was his FB like

Cant believe I am saying this - But I disagree with GreenBean

You have not sent him any money. He canceled eBay sale. You have nothing to worry about. There is no way to force payment from a buyer even if you had the item. Just walk away....

GreenBean 07-12-2010 09:55 AM

The OP states 'I asked him to cancel the sale on ebay which he did' But he(the seller) is asking for payment via paypal....:ranger:

i then asked him to cancel sale on ebay which he did. but he still sends me money requests i still said im not paying.

to cut a long story short hes contacted paypal

Think zippy should confirm that :peace:

thanks guys for the advice.

i did ask him to cancel the sale, but he then still sends me money requests by paypal asking me to pay for item.

i knew he was trying to rip me off , expecting me to pay after he says hes no longer got item! so i just said i would pay him if he canceled the sale on ebay, as i knew his little game ( so that clears me if he trys putting in a unpaid item dispute on ebay )

he cant be that bright as if he was smart he would not have canceled sale on ebay & he really thought i would pay all that money for nothink...i dont think so.:mad2:

but instead he still sends me paypal money requests and report me to payal after sale was canceled.

i even had a email off ebay stating im no longer obligated to purchase this ghost item.

guys a idiot ive heard it all now....
