ebay advice guys a refund
 

hi guys just need some advice regarding a tv i recently sold on ebay.

i sold a perfectly working tv on ebay which was 100% working, i even delivered the tv to the guys house set it up for him and he was happy and he payed me and i left.

2 days later he emails me saying the tv wont switch on and he wants his money back.

i emailed seller explaining item was sold as described and he seen it working perfect before he paid me.

i even told him i would replace the tv when i get another tv available.

but the seller is being a complete *ss as he wont wait & hes now reported me to to ebay so im not going to exchange the tv as i was only doing that out of good gesture.


he has now reported me to ebay filing a dispute as not described and not working. ( he even put seller said he would exchange tv and he has ingorned my emails ) :confused:


ebay have now sent me a email because this dispute is opened and i have 10 days to reply or ebay will decide on case.

what should i do here guys im not refunding this chump. as he clearly seen the tv working when i delivered and set it up and was happy to pay for item & is being a *ss about it.

i put no returns on my listings incase anythink like this happened.

should i tell ebay i delivered tv and guy seen it working before i left? should i just ignore the ebay dispute or or?

what would you advize my next step guys.

don't ignore it. respond to the case and explain very well what you did. the only bad he could do is leave negative feedback and whenever he sees you in the street calls you a jerk lol. respond back to it and explain to ebay. take a chance its 50/50 now...

Fight it off with all documentation handy but be prepared that you may be held liable.

The standard "Return for refund" is a staple of the dispute process. There really is no other way unless you want to kiss the account good bye.

im not happy as when i dropped it off to the guy i set tv up and showed him it all working.
he was happy then i left.

he then said he went into the settings of the tv and done a reset.

and now he says the tv wont come on.

surely i cant be held liable as the tv was shown working before i left. and somehow hes done somethink to the tv messing with the settings.

You never considered going back to his house to see if the TV was actually broken? The fact that you never mentioned this as an option has me thinking that something may have been wrong with the TV, and now your playing the "As is" card. Traditionally when pick ups are concerned, the buyer usually meets you, or comes to your residence. Why did you have to bring the TV to him... AND set it up no less? If eBay is seeing this like I am seeing this, you may be looking at an suspension.

You also know where he lives right - might be time for a close inspection...

nothink was wrong with the tv it was perfect, i had it for o13 months an never had a problem.

the buyer did not collect as he asked me if i could deliver the tv and show him it working before he paid me.

so i delivered set tv up an he seen it all working perfect was happy and i left.

he told me he messed about with the tv settings and tryed a tv reset now he said its faulty & it wont even come on. i was going to pop around until he started to be a complete a*s about it reporting me.

oh and i just checked the sale was canceled, the buyer agreed to cancel as i told him early on that if he agrees to cancel sale i will replace his tv with another tv when i get one in as a good gesture.

he was happy with that but decided to report me couple of days later saying tv is not working despite me saying i would swap it for another tv when i get one.

i dont know how the ebay dispute works but i have checked and the sale was canceled the buyer agreed to cancel sale.

if hes opened a dispute will ebay do anythink if the sale was canceled and the buyer agreed to cancel sale and now asking for a refund because he says tv is now not working?

so he cancelled and then put a SND dispute in after? This will add weight to your case but ebay may still ask you to refund him and arrange a return,

However you dont mention if it was paid by paypal, I assume not and it was cash on delivery right? they cant really do much if it wasnt paid via paypal. I just dont think you should mess with your account over this, you could get a neg (yes even if cancelled). Just go and pick up the TV and refund his money, BUT you should not have offered him another TV as a replacement, you do not need to do this, he is probably as cak-handed as I am with electronics and cant get a perfectly good item to work. You may get a neg for not giving him a replacement, but I personally wouldnt do it.

Is this the same item? You're running a big risk with what you are doing.
I'm perplexed at what is really going on. Items being delivered, working when you leave the house and breaking down a day or two later then a sale being cancelled. zippy, what's going on?
ebay are just as likely to side with the buyer given you saying one thing and then saying another...do you see where I am going?
Listing finished.
Item delivered.
Payment received.
Item reported broken.
Cancellation subject to certain conditions.
SNAD filed after cnxl.
