Ebay account suspended: Clause 9
 
Hi everybody,

I'm quite new in here and would need some information from older members.

Long story short, my original Ebay account got suspended around 6 months ago. So I bought myself the Stealth Guide and started all over again.

I thought I did everything right: got myself new ip address, changed absolutely all the information and started new Paypal account. Also I didn't sell anything for about month or so.

When I started selling I did it very slowly and didn't sell any Vero items. Mainly some old stuff from home.

Now suddenly yesterday I got an email from Ebay saying that my account has been closed permanently under the clause 9 in user agreement.

Now I read this clause 9 over and over again and I'm probably just stupid but I can't figure out what's the reason why they closed it. It doesn't even mention if it's something to do with the items I was selling or with my information.

So if there is somebody who knows anything about clause 9 and wouldn't mind explaining it to me I'd be more than happy to hear your advise.

Welcome to the forums. I have not read CLause 9 and would appreciate if you posted a link to it so bunch of us can read and apply to your situation.

So the email I got was following:

We regret that your eBay account has been suspended.

As per clause 9 of the eBay User Agreement, we may take this action if we are unable to verify or authenticate any information you provide us.

To familiarise yourself with our User Agreement, go to:

Due to the suspension of your account you are prohibited from using eBay in any way. This includes registering a new account.

And the Clause 9 is saying next:


Breach.

WITHOUT LIMITING OTHER REMEDIES AVAILABLE TO EBAY AT LAW, IN EQUITY OR UNDER THIS AGREEMENT, WE MAY, WITHOUT NOTICE TO YOU AND IN OUR SOLE DISCRETION (WHICH SHALL BE EXERCISED REASONABLY, HAVING REGARD TO THE CIRCUMSTANCES), DELAY LISTING YOUR ITEM, ISSUE YOU A WARNING, RESTRICT YOUR ACTIVITIES THROUGH OUR SITE (INCLUDING BUT NOT LIMITED TO BUYING, SELLING AND CHATBOARD POSTING ACTIVITIES), TEMPORARILY SUSPEND, INDEFINITELY SUSPEND OR TERMINATE YOUR MEMBERSHIP AND REFUSE TO PROVIDE OUR SERVICES TO YOU IF:

you have, or we believe that you have, breached this Agreement, which includes any of our Policies in any way (including those Policies referred to in Clause 18 below);
we are unable to verify or authenticate any information you provide to us;
we believe that your actions may cause loss or damage to or otherwise unlawfully harm you, our members, third parties or us, our related bodies corporate or affiliates, our directors, employees or agents; or

if we reasonably believe that any of Your Information (which includes an item listed on the Site) is inappropriate or of an offensive nature.

For security, confidentiality and privacy reasons, we are not obligated to provide you or other members the details of any investigation that we conduct or any action which we take, in relation to your membership or your account other than those that are already provided to you by us.

It is in English but not in ENGLISH, so if somebody could translate it to normal understandable language, it would be much appreciate it.

Its clause 9 which is clause 18, never personally had this.. BUT
from what i've read.. could be you maybe did a mistake on information.. like address not real could be common.. also ip is far away maybe..
furthermore.. could be ebay ID is offensive? just throwing a shot in the dark here..

also are the item you're selling offensive/inappropriate?

just wondering.. do you have any 3rd party software from ebay.. even skype?
could be something is linking you?

again not alot of experience on this.. maybe if greenbean stop looking at my smileys :pop2:she could help you out :pop2:

Now address is definitely correct and working and no problems with that.

IP address....well how far is too far. I live in Brisbane and in IP burger it usually shows that my IP address is somewhere in Sydney, which is like 1000 km away, I thought it's rather bizarre that it's so far away but not sure again and I can't do anything about it.

Well ad the items I sold where some shoes, handbags, clothing, all used and nothing new.


It's just frustrating how then can close you down just like that and not even giving you any explanations about it.

thats ebay for ya...
ip should be as close as possible generrally good to be within 10 miles.. MAAAAYB the reason.. not 100% sure however... it is rather bizzare..

any name brand?
Coach bags etc..

could also be a good combination of those things...
what about pictures?
email beacons?
what email company did you use.. images enabled/showed?

i dont really know just trying to run through my minds checklist.. something could be off
then again.. could just be ebay doing its thing:croc:

I've had this before, it could be anything, from being linked to a suspended account or suspected being linked to a suspended account.
Linking by IP addresses or any sort of tracking they use.

They won't tell you why as they don't want you knowing how they linked you, because you may find a way around it.

Personally, I think it's random. I've had some suspended immediately and others with complete made up everything, go great guns??

Best scratch that one and start clean again.

Create a few, but expect at least one to go down.

I don't bother asking anymore, just start again.

Clause 9 is usually part of MC049. It's a generic type of suspension. Normally reasons are not determinable.

It's more common in Australia, UK & Canada. But, as I said, it is frequently MC049 FPA, sometimes MC049 CIT... abusing ebay be we ain't gonna tell you 'cos we're ebay stuff.

Often there might be MC169 or MC000. ebay thinks the account smells :eek:

US users tend to get these infrequently.:pop2:

I get clause 9 when my account is linked or something is wrong with the information
