Default Just go first MC999 - Copyright Violation

My god. I was selling a desktop computer ( Compaq ).

Everything is legit, has Windows 7 CoA on the back. There was no mention of anything funny in the listing; just condition, warranty status, and specs.

How can they remove the listing and claim copyright violation? And do I need to do anything about it? Or should I just ignore it. This item doesn't even sell well at all on Ebay unlike Amazon. So I definitely won't relist it on Ebay in the future.

It could have been another competitor also selling Compaq computers.

The thing came from Microsoft I believe. Not from Compaq.

What do I need to to get rid of this "policy violation", I don't want it to stain or affect my account.

It won't go away unless you speak with some about it.

What picture did you use? Your own or someone else's?

No, EB and/or whoever reported you. If you relist again, you will just kill your account without approval.

The Email states, Microsoft reported.

I'm not quite sure what do to. Contact Microsoft and do what? They did give me some Microsoft email to find out more about why i got this violation. Already sent them an email about it.

Frankly, i find this retarded.

Well then you have done exactly what was needed and they are the only ones who can decide now, which is why they supplied that contact e-mail.

You must wait for them to respond or it will only happen again.

So basically I have to pursue Microsoft now to contact Ebay and remove the violation.

I've been out of the game for a bit so I may be fuzzy but, from what I remember if you want to fight this you're going to have to jump through a bunch of hoops.

Do not work with eBay on this they will only waste your time and give you canned responses. I'm not going to sit here and list step by step all the measures you have to take but this site will help you out if you want to fight the violation the right way plus he explains it better then I ever could:

I read somewhere that sellers are feeding in Windows7 (gray) software into old computers that they got for almost nothing, then selling then for more because of that sweet upgrade. That goes for other expensive software. Ebay is on to it.

You used stock photos which is not good. Take pictures of your computer and post them with your ebay username that should eliminate any problems.

Well with refurbs, it's usually a brown box, factory sealed.

Anyway, I did what jamblix suggested, and requested the counter noticed and faxed the information already.

Well I did the counter notice and just waiting up on them to see whats up.

Ready to provide them with invoice if they ask. Wonder if they'll bother sending an apology letter when all this is done( MS that is, no EB ).

ehhhh...sir it is microsoft. Bill Gates sends signed apology letters all the time. Ask any congressman or legislative rep in our government. Comes with a blank check as well.

Listing was re-instated recently. I didn't get any message from EB about policy violation being removed or anything like that.

Do I need to pursue further or is this as good as it gets?

Do you mean to say that you've re listed this item BEFORE a response from microsoft has been given to you on this item removal issue ???

Not sure who else you'd contact beyond microsoft & ebay in regards to your issue.

No. I received an email from Ebay that the listing is reinstated. I guess Microsoft never bothered to respond to the Counter Notice, since they had no evidence.

However the email does not say anything about the policy violation being removed.

This is a SSN account, so no point carrying this ridiculous violation with me for no reason; it might cause problems down the road, who knows.
