what are my chances on this dispute?
 
buyer purchased item from me. he turned around and sold it on amazon (i didn't know this). the person he sold it to is saying it looks 'used' and for him to send him a replacement and he wont send it back until he gets it

so the buyer from ebay contacted me saying can i send the buyer from amazon a replacement unit directly.
if i do this i wont be covered.
how do i know the guy who he sold it to will return my item.
he could be pulling a scam so then he turns around and opens a case against me so i tell my side of the story and escalate it. what do you think the outcome will be?

if they read our messages he even says he sold it on amazon.
can i send it to his buyer in another state .
usually i would comply with this but this sale was 400 dollars and i refused to be scammed.

the buyer signed up 3 months ago and most of his purchases are below 10 dollar items

i'm thinking you sold an item,a transaction which was between you and the original purchaser...end of transaction, period. if there are any issues it should be delt with between you two.

what the buyer did with it, or whomever he did it with is no concern to you at all.

think about it...if the original purchaser let his dog chew on it, then didn't package it well for shipping to this secondary amazon person, is that really your problem?

Don`t comply - resolve with the buyer via other means. All the best. This is way too much of a he did/she did issue - all the best.

he already opened a case against me saying the item not as described because i
refused his demands to send it to the other buyer.
I escalated the case and described to ebay in detail what the issue is.

what are my chances of winning?

if he tells his story like you put it on here, he is in the wrong.
if he puts it as if HE is complaining about it being snad then he would maybe win.
personally I would try and fight it. I am going thru similar thing right now.
every piece of advice I got was to accept a refund cos sellers do not win snad but I am going to fight it. Lets update each other!

well i have evidence through messages he sent me through ebay and emails where he clearly asks me to send to different address then his own and that the amazon buyer refuses to send it back to him so this is one of those rare circumstances where i wish ebay actually did read my ebay messages lol

I think if you have these messages to back up your story as described & EB are aware & made aware of these messages (I am sure they will have looked at these anyhow), he is toast.

Your EB transaction started & finished with him within the terms & conditions of the EB sales channel. You have no further responsibility or liability to him of what he subsequently does with the purchased item.

I would expect you to win this.

if you accept the return for a refund, then the guy will have 7 days to return the item for a refund, how's he going to do that if the other guy wont retun it to him.

that way you dont get a mark becasue you resolved and you will win the case because the guy can't return the item.

exactly this guy is putting me in a position i shouldnt even be in i just escalated 2 days ago to ebay i dont see how i can lose this case

thats the thing i dont even need the emails in our conversations through ebay he mentions the buyer through amazon and for me to send to another address so how do i forward those to ebay the case is already escalated

I can't believe it I actually won the case they released the funds they had on hold and said the case is closed I thought maybe they would side with the buyer cause they always find a way to make the buyer always right
