Not As Described Claim Question
 
I have a claim against me and wondering what my chances were of it going in my favor. I dropshipped a cell phone from Amazon to a seller on Ebay. This phone came directly from Amazon and not a third-party seller (it was a gold box deal of the day). The buyer has had it in his possession for almost three weeks but now claims it was defective upon arrival. He sent me an email in response to my wondering why he filed a claim and didn't contact me first and sounds like he is admitting he dropped it after a week of having it and now it doesn't work but his English is very broken (this is a domestic Asian bidder). There is a manufacturers warranty on the phone and I have provided both buyer and Paypal with this information. He has only had three recent transactions including me and the other two sellers he dealt with he has not paid (those transactions are nearly a month old). I contacted the other sellers to verify this and to warn them about him. The items he bought from the other sellers were the exact same make and model of phone.

Sounds fishy on his side. If he's had it for 3 weeks...it doesn't sound like he has a foot to stand on. If he dropped it then its his fault. Also, who makes a claim after 3 weeks? Stand your ground bro. Hope it works out in your favor.

Oh yeah, I definitely am! I have been in CONSTANT contact with Paypal supplying as much info as humanly possible. What really sucks is this hit right before X-Mas and I had a few last minute presents to get. Wish me luck.

Well, they sided with the buyer and he has to return the item to get the refund. I guess I should expect a brick in my mail sometime next week:mad2:

The package was returned via certified mail. If I refuse to sign for it, does that show up on the usps website i.e. would paypal be able to tell? also, he claimed to send it via ups but actually sent it usps. will paypal only check the ups site to verify delivery? i can't let this phucker win.

If everything the way you say it is then this moron needs to be taught a lesson. If you refuse the package it will say that it was refused. It comes from personal experience. I had a lady to buy from me and than pm me to cancel after it was shipped, i told her to refuse the package.
Here is how you can get this guys:
May be not to the extreme of calling cops but try to record the opening of the box and presented to eb/pp

tip. If you use a box/forwarder for returns, the manager will sometimes witness what is in box and take a pic, saying that it is being returned to an independant witness would disincentivise a scammer, as they know it is not just your word against theirs.
