Seller troubles again

Bought a phone that cost like $600.00 and got an empty package. I should of not opened the package, but I got so many items that I just started opening and just went and checked and this seller lives close by me. I opened a case, but hell I think ebay might think im lying. What's the best thing to do now? I have called the seller and emailed them, but can't get a response.

item not as described OR item not received?

FandangoKango 03-05-2012 11:31 AM

I chose item not as described since I thought if I chose item not received I would not win since tracking shows delivered.

GTB 03-05-2012 11:37 AM

good man

just hope for the best!

don't think there is much you can do

it's all in gods (i mean) paypals hands now

FandangoKango 03-05-2012 11:42 AM

That's right.

SNAD will be found in your favour (buyer) as ever with e/b & p/p

Job done.

Yes SNAD will force you to return the item however.

In your shoes I...

Would check this out...I like it when scammers try to get me but live closeby...unless this scammer is operating stealth...keep that in mind.

Have you tried to pull "Contact info?".

Either way - do the SNAD and hope for the best.

GTB 03-05-2012 12:29 PM

good luck with this mate

its alot of money to lose

rsot 03-05-2012 12:36 PM

Always a sketch buying something when the deal seems too good to be true - need to know the seller really well.

As an after thought, FanDango you aren't reverse playing are you? Asking a q for a buyer in your situation?

Not always the case. People read too many fantasy stories on the forums about that.

Just recently had an Amazon buyer who tampered with an item, opened a case, and returned the "broken" item back. Simply reported buyer the Amazon, and his SNAD case was closed. He is out of 300$ and the item. I lost 10$ in shipping, but after the item gets back from RMA, it will be re-listed :)

i like the way you think.

It's not advised to file a chargeback together with a dispute, one or the other will be dismissed by Paypal I believe, if you file both.

FandangoKango 03-05-2012 03:15 PM

No im not playing. This is really me. I bought from a seller with 60 feedback and has a store and other phones selling, but all his seller feedback is private. He was selling for around the same price as others. I just want the phone, but the guy is playing. Im going to see what happens.

Can't file a chargeback. I used paypal funds. No credit/debit was involved.

rsot 03-05-2012 04:58 PM

Ugh - from now on, when doing big purchases, try to go for cc protection.

As a buyer you are repeating your errors.

You wanted the last phone and got stung.

You want this phone & might get stung again.

You need to change your WANTS quickly.:rip:

Wrong info.

From ebay buyer protection.....
You have not initiated another form of resolution processing, including credit card chargebacks (if you paid by credit card) or PayPal Buyer Protection claims (if you paid by PayPal).

from paypal buyer protection

13.8 No Double Recovery. You may not file a Dispute/Claim, or receive a recovery, for a purchase under PayPal Purchase Protection if you have already received a recovery for that purchase directly from eBay or the Seller.

Double dipping stopped 2010:rip:

FandangoKango 03-06-2012 08:38 AM

Can't file a paypal claim as It said I already filed through ebay so take it through there.
