Default Ridiculous buyer - Can they dispute?

Okay...so I have a wack buyer that is trying to take me for my money on a return that is very shady.

They left positive feedback, went ahead and accepted the mutual cancellation, and now I am in a position to decide whether to refund or not. Overall, I would be put at a bigger loss then the item actually sold for and then what he paid me.

Main question I need advice on is will he be able to file a dispute with eBay or PayPal...and should I refund him? I have no product. He has UPS tracking # to some unknown location of "my product"

eBay/PayPal almost ALWAYS sides with the buyer. If the item is being returned to you, you might want to wait a couple of days until you receive it. But the reality is, at the end of the day, eBay/PayPal are much more interested in protecting the buyers, rather than the sellers.

jeff is right that they always side with the buyer but wait for the item or if you have the tracking number for the item then just call the post office and ask to change the address to your own.

Thanks for your response guys. See the thing is, he already sent out the item to some bogus address over 2 weeks ago and it was delivered in the matter of days and signed by some odd computer robot looking name.

Does it not matter tho that the transaction has been cancelled and he had already left positive feedback? I got a feeling that I will have to take the hit but would love to avoid it.

Hold up, you're saying 2 weeks ago this guy returned your merch to an unknown address and signed by a name that is not yours. You both cancelled the transaction and he left you positive feedback. So right now, you're deciding if you should refund him or not...?

What the hell, I wouldn't refund him at all until I got my item back. I mean you have proof in the tracking don't you? He sent it to the wrong address and the wrong person, he's either really dumb or he's pulling a gambit or both imo.

Do not refund anything. Get your story straight and the order of events right if he tries to create any trouble for you.

I'm still not sure what your story is but if he didn't get the item back to you then there is no refund.

Well lo and behold this buyer is the deutsch of all deutschbags. He decided to contact eBay and got my selling account an MC011 limit.

I went ahead and refunded the money to the idiot guy...I should have just done it and considered it a business expense in the first place rather than risking it being escalated to something bigger.

Well...the first eBay rep I spoke to was a dick and wouldn't tell me why I was limited and practically forced me off the phone.

The second rep I talked to was nice and told me it was because of a buyer complaining that I was accusing him of being deceptive and I wouldn't refund the money. There is a little more to it but his idiot ass got me limited.

They are asking for invoices or receipts from my supplier. I have gathered about 50 pages of invoices and reports along with a professional typed out fax cover sheet and letter head explaining the situation and also stating I have refunded the fag his money.

I called back an hour and half later to see if they got it and an eBay rep called the Trust and Safety Department to check...he said they got it and I should be getting an email back within 24 hours and my account should be reinstated as well......

Crossing my fingers...lets see what happens.

Your account can be limited immediately like that for one report? Even when you didn't get the item back?

Apparently so! I had literally exchanged messages with him 2 hours before...then I was on the way to do some maintenance on my car and got the MC011 message in my email.

It could also be that eBay was simply wanting to get my supplier info on file as I have been running a very high volume of sales very quickly in the month.

Making better sense in terms of pp's decision now. Not to say that pp is correct but I see their risk assessment.

My PayPal account is 100% okay, there is nothing going on with it. Its just my eBay account.
