anyone heard of this before.

a seller is (going to submit my claims to the county court on monday)
the claim i left a neg feedback for him.
i think the claim is for loosing future sales due to the neg feedback.

as i bought 2 items and he charged £6.22 and the postage was£1.85 with £0.65 for the envlope..
so i left neg feedback stating the cost and what he charged.

can he do this and win..

YES ITS A COUNTY COURT CLAIM ONLILNE

if he wins the case (or you cant prove yours) then you will end up with a county court judgement which will screw up your credit file

oh and about £50 costs on top of it

buyer did it to me

claimed for stress and worry, time for writing emails etc

claimed for around £250 for a £20 item

he lost though as i was able to prove my case

no he says if i do not remove the feedback by monday he will open a case on this monday..16/7/12..when they open..
and all this happens in the last 2 houres.

no edeted 1 post got the date and spelling wrong..
and why would i be playing..playing at what..

and if he had sent 2 packages fine .i would have taken it.but sent the 2 items in 1 package and no discount and since the items weghe like 20 grams each it was no extra in the postge cost.
he has got £4.00 for nothing.
i sell and have been selling and i never go that much over on P+P,
if they pay too much i refund them.EG last refund £1.20 for overpayment on postage..all helps to the buyer and keep him sweet....

Can i ask , How would you have felt as a seller if someone left you bad feedback over postage costs ? i know its not likley to happen becuase you refund it all but how would you feel ?

That one bad feedback could have a massive knock on effect.

Pretty ****ty thing to do if you ask me, why on earth you didn't contact him regards the postage before leaving feedback is beyond me.

was it worth it ?

Agreed with Tizwoz you should have contacted him before leaving negative feedback, you are a seller yourself so you know how bad negative feedback will affect a business.

i did contact him.once after the sales to combine postage cost before i paid he siad no..
so i thought ok he is sending special delivery which is £5.90 over here.no problems ,
then the package came and it cost £1.85
so i contacted the seller .and he said £1.85 £0.65 for envolope and i dont combine posstage.and then he said i could include a 5% paypal fee and ebay fees aswell,,
and truthfully he was a big headded clever twat.that would not budge at all.
he said.
that's the price i said and that is what you pay end of story.

i have said refund the price of 1 £3.11 and i will remove the neg.he said im taking you to samall claims court for loss of sales..and ebay will kick me off..

and i not playing anyone this is the truth.

Tell him to do it and then inform him you will be counter claiming for the stress you are suffering due to his unjustifiable harrassment - also tell him you will be informing Ebay of his harrassment

just checked his feedback and got 5 negs in total of 71 well 6 with mine,
2x Didn't arrive had to use resolution centre
2x damaged
1x postage cost

Your the "twat" for agreeing to the postage when bidding, then leaving a neg once you've seen how much the seller charged.

Would it have made a difference if it was "free" postage?

I know that there have been a few cases of an eBay seller suing a buyer over negative feedback here in the US. To win, they basically have to show that the comment left was untrue and/or malicious.

I do not know if the law in the UK works the same way.

However, before I would leave negative feedback for anyone, I would always try to work it out first. If that did not work, I would write the negative and look at it the next day to make sure what I said was the absolute truth. Only THEN would I post it.

In this case, I think the OP WAS in the wrong, even though his negative comment may be true. The fact is, unless the shipping was added after the purchase, the OP KNEW what the charges would be before the deal was made. And if he didn't like it, he could have done several things, such as buying from another seller or negotiating the shipping charges with original seller.

Unless the seller deceived the buyer in some way, I'd have to side with the seller on this one.

someone saying they are taking you to small claims court tomorrow is not a problem. They will file a claim against you and have to pay up front in advance depending on how much they are claiming.
You will be sent a form to complete with your answer and plea. Then it goes into the system and it could take ages to a first pre case meeting if they allow it to get to that stage if it is a weak claim.

When it does if his case against you is weak the judge will say to them your case is going now where if they decide to proceed and lose after being told going nowhere they could be hit hard with costs against them for not taking the hint to back out or run the risk of paying you costs plus this and that.

If they have a good case then offer to settle before court. Look around for free legal advice. you often get 15 minutes free with a duty solicitor at advice centres. check your home insurance policy many have a free legal cover including telephone advice on them for this stuff. They are trying to rattle you, hold your nerve.

some sellers make up for the fact that they want lower fees, by hiking postage, if you got a good deal on item then maybe the extra postage enabled that.....plus you saw the postage costs, why did you bid on it then? only time this neg is justified is if he said tracked more expensive delivery and sent it economy and charges you the higher amount. If ebay think there are no grounds to remove it - and I am sure seller tried them first, then why on earth would a judge, what a pointless case.

I doubt he will go through with it or be successful if he does.......anyway if you think he will go ahead you have option of getting feedback removed with ebay, maybe you could change it to a neutral now and forget all this.....

on the other side this seller is a baby, maybe there is a knock on effect but all sellers run the risk, some get ones that are even more unfair....
