has anyone taken a buyer to small claims over negative feedback?

Very curious if anyone has done this

On my past account I tried to sell a few cheap coins. One person bought 3 of them. I never got in my shipment so I refunded them quickly. Few weeks later this person leaves me 3 negative feedbacks. Id say an abuse of the system. Btw the coins were $1 each! Sick world

Hardly an abuse of the system when you sold something that wasnt actually in your possession.

I doubt youd be able to sue anyone over negative feedbacks.
Besides it kind of sounds like he was entitled to do so to begin with... not a nice thing to do on his part but it is his right to do so none the less... And I mean no offense.
The only recourse you would have is contacting Ebay about it but like I said according to the terms Ebay has for FB he had the right to leave that feedback since he was not happy with the way the transaction went (i.e. not getting the item he won and paid for).
If youre talking about amazon Im not sure how that system works but I cant imagine it would be any different.

Yes that was not the smartest idea but I still think it is abuse. The buyer never sent a message, never responded to any messages and never returned a phone call

Some buyers are reasonable and will work it out, others are di cks and want you to bow down to them, but, unfortunately its within their rights as they expected quality service and you couldnt deliver for whatever reason.

slim jim 07-15-2012 01:13 PM

The reason I asked this is because ebay says they will take off feedback with a court order so I was curious if anyone went that route

LoopHole 07-15-2012 01:18 PM

What was the negative feedback? You would be surprised what type of feedback i got taken off by eb by emailing them. All you have to do is back up what you say.

jeffweico 07-15-2012 02:01 PM

If the feedback is TRUE, then there is very little you can do, other than asking the buyer to remove it.

If the feedbak is a lie, then the courts MAY be able to help you.

Generally speaking, however, I don't see this going anywhere.

Thx everyone for your ideas

I'd be curious to know how your correspondence went when trying to contact the customer. Was it a bunch of, "this aint right man!", or "what is wrong with you"?

In this case, I would start off by just saying that he can have the coins for free (if you can still obtain them). This is the best way to at least get a response.

After he says yes that sounds great, then I usually say, sure no problem, I already got permission from my manager, he only asks that you please remove your negative feedback as we are doing everything we can to help resolve the issue.

Hell I'd give him 20 coins to remove 3 feedback. If you're talking Amazon, I have given discounts up to 20 dollars to avoid negative feedbacks. Remember, you are your customer's bitch thanks to the feedback system.

I am always professional. The account had 100% feedback up to that point and most items I sold were over $300. Sent refund right away with a message explaining the situation. No contact at all before or after the feedback
